SUBSTITUTE FOR

SENATE BILL NO. 360

                                                                             A bill to amend 1994 PA 451, entitled                                             

"Natural resources and environmental protection act,"                       

by amending section 8317 (MCL 324.8317), as amended by 2002 PA              

418.                                                                        

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1       Sec. 8317.  (1) An application submitted under this part                    

2   shall be accompanied by the following application fee:                      

3       (a) For a commercial applicator certification, $75.00.                      

4       (b) For a private agricultural applicator certification,                    

5   $10.00 $50.00 if paid on October 1, 2003 through September 30,            

6   2007, and $10.00 if paid through September 30, 2003 or after                

7   September 30, 2007.                                                         

8       (c) For a commercial registered applicator, $45.00.                         

9       (d) For a private registered applicator,  $10.00 $50.00 if                 

10  paid on October 1, 2003 through September 30, 2007, and $10.00 if           

1   paid through September 30, 2003 or after September 30, 2007.                

2       (2) Certificates for commercial applicators, private                        

3   agricultural applicators, and registered applicators shall be               

4   valid for a period of time of not less than 3 years to be                   

5   established by rule by the director.                                        

6       (3) The license application fee for a commercial applicator                 

7   license is $100.00.  The license shall expire on December 31                

8   annually.                                                                   

9       (4) The registration application fee for the registration of                

10  pesticides sold, offered, exposed for sale, or distributed is               

11  $40.00 per product.                                                         

12      (5) The license application fee for a restricted use                        

13  pesticide dealer's license is $100.00.  The license shall expire            

14  annually on December 31.                                                    

15      (6) Application fees submitted under this section are not                   

16  refundable.
