A bill to amend 1954 PA 116, entitled
"Michigan election law,"
by amending section 311 (MCL 168.311), as added by 2003 PA 302.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 311. (1) If less than a majority of the offices of
2 school board member of a school district become vacant, the
3 remaining school board members shall fill each vacant office by
4 appointment. If a vacancy in the office of school board member
5 is not filled within 30 days after the vacancy occurs or if a
6 majority of the offices of school board member of a school
7 district become vacant, the intermediate school board for that
8 school district shall fill each vacancy by appointment. An
9 individual appointed under this subsection serves until a
10 successor is elected and qualified.
11 (2) If a vacancy occurs in an office of school board member
1 more than 90 days before a regular school election, an election
2 shall be held at that regular school election to fill that office
3 for the remainder of the office's unexpired term, if any. This
4 subsection applies regardless of whether an individual is
5 appointed under subsection (1) to fill the vacancy.
6 (3) Within 3 days after an appointment is made to fill a
7 vacancy in an elected office in a school district, the secretary
8 of the school board shall notify the school district election
9 coordinator, in writing, of the name, address, and office of the
10 person who vacated the office as well as the person filling the
11 office.
