SUBSTITUTE FOR
HOUSE BILL NO. 6333
A bill to amend 1970 PA 38, entitled
"An act to provide for assessment and remedial assistance
programs of students in reading, mathematics and vocational
education,"
by amending section 2 (MCL 388.1082).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2. (1) The statewide assessment program of educational
2 progress shall cover all
students annually at two in at least 2
3 elementary and middle school grade levels in public schools. If
4 the federal government requires assessments at additional grade
5 levels under the no child left behind act of 2001, Public Law
6 107-110, the superintendent of public instruction shall ensure
7 that this state complies with those requirements.
8 (2) The department
of education, hereinafter referred to as
9 the department, superintendent of public instruction shall
10 develop and conduct the assessment
program , and may utilize
1 the assistance of
appropriate testing organizations and/or or
2 testing specialist specialists.
The program shall expand the
3 current basic skills
testing inventory in grades 4 and 7
4 coordinated by the
department. Beginning with
assessments
5 conducted in the 2005-2006 school year, all of the following
6 apply to the assessment program:
7 (a) The superintendent of public instruction shall ensure
8 that any contractor used for scoring an assessment instrument
9 supplies an individual report for each student that will identify
10 for the student's parents and teachers whether the student met
11 expectations or failed to meet expectations for each standard, to
12 allow the student's parents and teachers to assess and remedy
13 problems before the student moves to the next grade.
14 (b) The superintendent of public instruction shall ensure
15 that any contractor used for scoring, developing, or processing
16 an assessment instrument meets quality management standards
17 commonly used in the assessment industry, including at least
18 meeting level 2 of the capability maturity model developed by the
19 software engineering institute of Carnegie Mellon university for
20 the 2005-2006 school year assessments and at least meeting level
21 3 of the capability maturity model for subsequent assessments.
22 (c) The superintendent of public instruction shall ensure
23 that any contract it enters into for scoring, administering, or
24 developing an assessment instrument includes specific deadlines
25 for all steps of the assessment process, including, but not
26 limited to, deadlines for the correct testing materials to be
27 supplied to schools and for the correct results to be returned to
1 schools, and includes penalties for noncompliance with these
2 deadlines.
3 (d) The superintendent of public instruction shall ensure
4 that the assessment instruments meet all of the following:
5 (i) Are designed to test students on grade level content
6 expectations in all subjects tested for each grade level tested.
7 (ii) Include not more than 2 written response portions for
8 English language arts for each grade level and do not include a
9 written response portion for mathematics or science.
10 (iii) Comply with requirements of the no child left behind
11 act of 2001, Public Law 107-110.
12 (iv) Are consistent with the code of fair testing practices
13 in education prepared by the joint committee on testing practices
14 of the American psychological association.
15 (e) The superintendent of public instruction shall work with
16 the assessment advisory board established in section 1279h of the
17 revised school code, 1976 PA 451, MCL 380.1279h, as applicable.
18 (3) The program shall assess competencies in the basic skills
19 and collect and utilize other relevant information essential to
20 the assessment program.
21 (4) Based on information from the program, the public schools
22 shall identify students shall
be identified who have
23 extraordinary need for assistance to improve their competence in
24 the basic skills and shall identify students who have
25 demonstrated extraordinary competence in multiple subject areas
26 who should be recommended for advancement.
27 (5) Information from the program shall be given to each
House Bill No. 6333 (H-2) as amended December 2, 2004
1 school as soon as
possible in accordance with deadlines
2 established under section 1279h of the revised school code, 1976
3 PA 451, MCL 380.1279h, to
assist it the school in its efforts
4 to improve the achievement of students in the basic skills.
