SUBSTITUTE FOR
HOUSE BILL NO. 5842
A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending sections 617, 617a, 618, and 619 (MCL 257.617,
257.617a, 257.618, and 257.619), section 617 as amended by 2001
PA 159 and section 619 as amended by 1999 PA 73.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 617. (1) The driver of a vehicle who knows or who has
2 reason to believe that he or she has been involved in an accident
3 upon either public
or private property , when the property
4 that is open to travel by
the public , resulting in serious
5 impairment of a body
function or death of a person shall
6 immediately stop his or her vehicle at the scene of the accident
7 and shall remain there until the requirements of section 619 are
8 fulfilled. The stop shall be made without obstructing traffic
9 more than is necessary.
1 (2) Except as
provided in subsection (3), a person who
2 violates if the individual fails to comply with
subsection (1)
3 and the accident results in serious impairment of a body function
4 or death, the individual is guilty of a felony punishable by
5 imprisonment for not more than 5 years or by a fine of not more
6 than $5,000.00, or both.
7 (3) A person who If
the individual violates subsection (1)
8 following an accident
caused by that person that individual and
9 the accident results in
the death of another person individual,
10 the individual is guilty of a felony punishable by imprisonment
11 for not more than 15 years or a fine of not more than $10,000.00,
12 or both.
13 Sec. 617a. (1) The driver of a vehicle who knows or who has
14 reason to believe that he has been involved in an accident upon
15 either public or private property , when the property that
is
16 open to travel by the
public , resulting in injury to a person
17 shall immediately stop his or her vehicle at the scene of the
18 accident and shall remain there until the requirements of section
19 619 are fulfilled. Every

20 obstructing traffic more than is necessary.
21 (2) A person
failing to stop or If an individual fails to
22 comply with those
requirements shall be subsection (1) and the
23 accident results in injury to any individual, the individual is
24 guilty of a misdemeanor ,
punishable by imprisonment for not
25 more than 1 year , or
by a fine of not more than $1,000.00,
26 or both.
27 (3) The secretary of state shall suspend the operator's or
1 chauffeur's license of the
person an individual convicted of
2 violating this section as provided in section 319.
3 Sec. 618. (1)
The driver of any a vehicle who knows or
4 who has reason to believe that he has been involved in an
5 accident resulting
only in damage to a vehicle which is driven
6 or attended by any
person upon public or private
property that
7 is open to travel by the public shall immediately stop such his
8 or her vehicle at the
scene of such the accident and shall
9 remain thereat there
until he has fulfilled the requirements
10 of section 619 are
fulfilled. Every such The stop shall be

traffic more than is necessary. Any
12 person failing
13 (2) If an
individual fails to stop or comply with said
14 requirements under
such circumstances shall be the
requirements
15 of subsection (1) and the accident results in damage to a vehicle
16 operated by or attended by any individual, the individual is
17 guilty of a misdemeanor punishable by imprisonment for not more
18 than 90 days or a fine of not more than $100.00, or both.
19 Sec. 619. The driver
of any a vehicle who knows or who
20 has reason to believe that he or she has been involved in an
21 accident resulting in
injury to or death of any person or damage
22 to any with an individual or with another vehicle which
that
23 is driven operated
or attended by any person another
24 individual shall give
do all of the following:
25 (a) Give his or her
name , and address, and the
26 registration number of
the vehicle he or she is driving, also
27 operating, including
the name and address of the owner, and
1 exhibit to a police officer, the individual struck, or the
2 driver or occupants of the vehicle with which he or she has
3 collided.
4 (b) Exhibit his or her operator's or chauffeur's license to a
5 police officer, or
the person individual struck, or the driver
6 or occupants of any the
vehicle with which he or she has
7 collided. with

8 (c) Render to
any person individual injured in such the
9 accident reasonable assistance in securing medical aid or arrange
10 for or provide
transportation of to any injured person or
11 persons individual.
