SUBSTITUTE FOR
HOUSE BILL NO. 4641
(As amended September 30, 2003)
A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 30502a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 30502a. (1) For natural river areas that are
2 designated under this part on or after January 1, 2003, the
3 following apply:
4 (a) [Four] years after the date the designation is made, the
5 counties and townships in which the natural river area is located
6 may review the designation for a period of not more than 90
7 days. If, during this 90-day period, the governing bodies of a
8 majority of the total number of counties and townships within the
9 natural river area pass resolutions to rescind the designation as
10 a natural river area, the commission shall rescind the
11 designation at the next regularly scheduled meeting of the
1 commission.
2 (b) Beginning 10 years after the beginning of the 90-day
3 review period under subdivision (a) and every subsequent 10 years
4 thereafter, the counties and townships in which the natural river
5 area is located may review the designation of the natural river
6 area. If, within 90 days of each 10-year time period, the
7 governing bodies of a majority of the total number of counties
8 and townships within the natural river area pass resolutions to
9 rescind the designation as a natural river area, the commission
10 shall rescind the designation at the next regularly scheduled
11 meeting of the commission.
12 (2) If the commission rescinds a designation under subsection
13 (1), the commission shall not redesignate that natural river area
14 for at least 10 years after the designation was rescinded unless
15 a majority of the total number of counties and townships within
16 the natural river area pass resolutions approving the
17 redesignation.
18 Enacting section 1. This amendatory act does not take
19 effect unless House Bill No. 4642 of the 92nd Legislature is
20 enacted into law.
