A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 11514 (MCL 324.11514).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11514. (1) A person shall not knowingly dispose of,
2 and an owner or operator of a landfill shall not knowingly permit
3 the disposal of, medical
waste either of the following in a
4 landfill:
5 (a) Medical waste, unless that medical waste has been
6 decontaminated or is not required to be decontaminated but is
7 packaged in the manner required under part 138 of the public
8 health code, Act No.
368 of the Public Acts of 1978, being
9 sections 333.13801 to
333.13831 of the Michigan Compiled Laws
10 1978 PA 368, MCL 333.13801 to 333.13831.
11 (b) Beginning January 1, 2006, a cathode ray tube, including
House Bill No. 4296 as amended November 13, 2003
1 a television or computer monitor containing a cathode ray tube.
2 (2) Not later than January 1, 2004, the department shall
3 convene a task force made up of representatives of manufacturers
4 of electronic equipment, environmental organizations, retail
5 businesses that handle electronic equipment, members of the
6 general public, and other interested persons. Not later than
7 June 1, 2005, this task force shall provide to the legislature a
8 report on the adequacy of regulatory programs related to the
9 disposal of electronic waste and in particular electronic waste
10 containing cathode ray tubes.
[(3) No later than 60 days prior to the effective date of the prohibition created by this amendatory act for cathode ray tubes, the department shall develop a policy for enforcement of that prohibition that, at a minimum, considers the efforts of the owner and operator of a solid waste disposal facility to prevent disposal of a cathode ray tube at the facility. Such efforts may include the following:
(a) Posting of clearly visible and easily read signs at the facility, providing notice of the prohibition of the disposal of cathode ray tubes.
(b) Written notification to or contractual agreements with the facility's customers providing notice of the prohibition of the disposal of cathode ray tubes.
(c) Upon request, providing customers information about collection programs and facilities that are permitted to accept cathode ray tubes for recycling.]
