JOINT MUNICIPAL PLANNING: LAND USE H.B. 6047 (H-1): COMMITTEE SUMMARY
House Bill 6047 (Substitute H-1 as passed by the House)
Sponsor: Representative Chris Ward
House Committee: Land Use and Environment
Senate Committee: Natural Resources and Environmental Affairs
Date Completed: 9-20-04
CONTENT
The bill would amend the Joint Municipal Planning Act to require a joint planning commission agreement to indicate that a municipality approving the agreement would not have to provide every use provided for in a joint plan adopted by the commission, as long as the use was provided for overall in the joint plan.
Under the Act, the legislative bodies of two or more municipalities may adopt ordinances approving an agreement to establish a joint planning commission. The agreement must contain provisions set forth in the Act, such as the composition of the commission and its jurisdictional area. When a joint planning commission is established, all of the powers and duties of a municipal planning commission are transferred to the joint commission with respect to its jurisdictional area. In addition, all of the powers and duties of a zoning board or zoning commission under the City and Village Zoning Act or the Township Zoning Act are transferred to the joint commission.
