JOINT MUNICIPAL PLANNING: LAND USE H.B. 6047 (S-2): FLOOR ANALYSIS

CONTENT
The bill would amend the Joint Municipal Planning Act to provide that, if the joint plan of a joint planning commission allocated land for a particular use within the territory of a participating municipality and the jurisdictional area of the commission, then the joint plan would not have to allocate land for that use within the territory of any other participating municipality. In addition, the plan of a participating municipality would not have to allocate for that use land that was within the municipality's territory but outside the jurisdictional area of the joint planning commission.
Also, if the plan of a participating municipality allocated for a particular use land that was within the municipality's territory but outside the jurisdictional area of the joint planning commission, the joint plan would not have to allocate land for that use. (The bill refers to the plan of a municipality under Public Act 285 of 1931 or Public Act 168 of 1959, which provide for cities, villages, and townships to adopt plans for the development of their territory.)
(Under the Joint Municipal Planning Act, the legislative bodies of two or more cities, villages, and townships may adopt ordinances approving an agreement to establish a joint planning commission. The agreement must contain provisions set forth in the Act, such as the composition of the commission and its jurisdictional area. When a joint planning commission is established, all of the powers and duties of a municipal planning commission, and all of the powers and duties of a zoning board or zoning commission, are transferred to the joint commission with respect to its jurisdictional area.)
