LABORATORIES: ADVISORY COUNCIL S.B. 1135 (S-5): FLOOR ANALYSIS

CONTENT
The bill would amend the Natural Resources and Environmental Protection Act to create the Laboratory Data Quality Assurance Advisory Council. The bill is tie-barred to Senate Bill 1133, which would require the Department of Environmental Quality (DEQ) to implement a Laboratory Data Quality Recognition Program to identify commercial laboratories qualified to generate data for submission to the Department.


The Advisory Council would have to consist of the DEQ Director, and one representative from each of the following interests: a statewide business organization, commercial labs, in-house labs, municipal labs, and the Michigan Municipal League. The members would be appointed by the Governor.


The Council would have to monitor and evaluate the proposed Quality Recognition Program; develop recommendations whether the Program should be retained, revised, or replaced with a laboratory inspection program or a nationally recognized accreditation program; evaluate the Program's costs to private business; review the DEQ's laboratory data acceptance requirements; recommend whether a commercial laboratory code of ethics was needed; and develop recommendations as to whether the DEQ should provide additional technical and training assistance to commercial laboratories and labs owned by public agencies.

The bill would result in minimal expenses related to reimbursement of actual and necessary expenses incurred by members of the Council.
