A SUMMARY OF HOUSE BILL 6049 AS INTRODUCED 6-24-04
House Bill 6049 would amend the City and Village Zoning Act to specify that a city or village could by ordinance provide restrictions on the location of and the distance between retail licensed liquor establishments and adult entertainment businesses involving nudity.
The bill also specifies that a city or village could purchase, condemn, or otherwise acquire private property (or an interest in private property), for the removal of nonconforming uses and structures that existed at the time an ordinance was enacted. The bill declares that the elimination of such nonconforming uses and structures would be for a public purpose. The bill would define “nudity,” as that term in defined in section 916 of the Michigan Liquor Control Code.

FISCAL IMPACT:
The fiscal impact on the State or on local units of government is indeterminate. It is not clear what the economic impacts may or may not be by allowing cities and villages to impose these additional zoning restrictions.
