A SUMMARY OF HOUSE BILLS 5877-5880, 5883, 5891-5895, 5900, 5902, AND 5904 AS INTRODUCED 5-12-04

Generally speaking, the bills would each amend a different act to require that an application for a license, registration, or permit submitted after the bill’s effective date be issued within six months or, in some cases, 180 days, after the applicant submits a completed application. (In a few cases, a different existing statutory deadline would apply.) If the responsible state official determined that an application is incomplete, he or she would have to notify the applicant in writing within 10 days, describing the deficiency and requesting the additional information.

If the appropriate official fails to grant or deny an application within the required time, he or she would have to return the applicant’s application fee and would discount the next renewal fee by 15 percent. The appropriate official would be prohibited from reviewing an application with a returned fee in a manner that differs from the review process employed for other applications.

On each January 31, beginning in 2005, the appropriate department would have to submit a report to the legislative standing committees and appropriations subcommittees of the House of Representatives and Senate with jurisdiction over the given subject matter for the preceding calendar year. The report would include (1) the number of applications processed and not processed within the required time; (2) the average time to process applications after the time required; (3) the number of applications denied, and reasons for the denial; (4) the number of applications for which additional information was requested, and the average time to fulfill a request; and (5) the amount of application fees returned.

House Bill 5877 would amend the Motor Fuels Quality Act (MCL 290.646 and 649i) to apply to licenses distributors and retail dealers of gasoline and to permits for dispensing facilities.

House Bill 5878 would amend the Michigan Liquor Control Code (MCL 436.1525) to apply to licenses issued and renewed under the code.

House Bill 5879 would amend the Food Law of 2000 (MCL 289.4116) to apply to food establishment licenses.

House Bill 5880 would amend Public Act 116 of 1973, dealing with child protection, to apply to licenses for child care organizations and registration of persons operating family day care homes.

House Bill 5883 would amend the Private Detective License Act (MCL 338.829 et al.).

House Bill 5890 would amend Public Act 227 of 1967 (MCL 408.815 and 816) to apply to elevator contractor licenses and elevator installation or alteration permits.

House Bill 5891 would amend the Asbestos Abatement Contractors Licensing Act (MCL 338.3209 and 3211).

House Bill 5892 would amend the Stille-DeRossett-Hale Single State Construction Code Act (MCL 125.1510a) to apply to building permits under the code.

House Bill 5893 would amend the Private Security Business and Security Alarm Act (MCL 338.1059 et al.).

House Bill 5894 would amend the Forbes Mechanical Contractors Act (MCL 338.976 and 980) to apply to licenses for contractors under the act.

House Bill 5895 would amend the Public Health Code (MCL 333.20162) to apply to licenses for health facilities and agencies, ambulance operations, nontransport prehospital life support operations, aircraft transport operations, or medical first responder services.

House Bill 5900 would amend the Electrical Administrative Act (MCL 338.883) to apply to licenses for master electricians, electrical contractors, electrical journeymen, fire alarm contractors, fire alarm specialty technicians, sign specialty contractors, and sign specialists.

House Bill 5902 would amend the Occupational Code (MCL 339.207 et al.) to address licenses for occupational schools, approvals of continuing education programs, and licenses and registrations for various occupations and titles covered under the code.

House Bill 5904 would amend the Boiler Act (MCL 408.754a) to apply to licenses for installers and repairers of boilers and permits required to install and repair boilers.
