A SUMMARY OF HOUSE BILL 5864 AS INTRODUCED 5-11-04

Under the current law, the Department of State Police may charge a fee, not to exceed $15.00, or, until October 1, 2004, not to exceed $30.00, for taking and processing the fingerprints and completing a criminal record check of a resident of this state when the impression of the fingerprints are requested for employment-related or licensing-related purposes. 

House Bill 5864 would amend the current law by eliminating sunset date on fees for fingerprinting and criminal record check.  The bill would also delete subsection (2), which requires the Department to submit a written report by October 1, 2003 stating whether the fee increase provided under the amendatory act is sufficient to support the actual costs of fingerprinting.

FISCAL IMPACT:

The actual cost of taking and processing the impression of the fingerprints and completing a criminal record check on a person is $29.83.  The Department of State Police has submitted a written report on September, 2003, stating that the fee of $30.00 is sufficient to support the actual costs of fingerprinting.

House Bill 5864 would have no fiscal impact on the state and local governments.
