A SUMMARY OF HOUSE BILL 5063 AS INTRODUCED 9-24-03

         House Bill 5063 would amend the Natural Resources and Environmental Protection Act to add a new section which specifies that notwithstanding other provisions of the act, the Department of Environment Quality could not issue a permit to install an air pollution source if that source were located within 1,000 feet of a child care center, a preschool, a public or nonpublic school, or a residential dwelling.  As used in this section, “source” would be defined to mean an incinerator, a coal-fired power plant, or any major emitting facility.
