A SUMMARY OF HOUSE BILL 4069 AS INTRODUCED 1-28-03

The bill would amend the Youth Tobacco Act to prohibit a retailer from selling cigarettes packaged in packs of fewer than 20 cigarettes.

A violation would be a misdemeanor punishable by a fine of not more than $500 for each offense. (This is the same penalty for violating the current prohibition in the act against selling a cigarette separately from its package.)

The provision would not apply to the sale of tobacco products in a tobacco specialty store or other retail store that deals exclusively in the sale of tobacco products and smoking paraphernalia.
