Rep. Drolet, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

This fee increase raises court costs on speeding tickets by ten dollars. It is in addition to an identical cost increase on the tickets themselves enacted into law last session. All of it because government needs more cash so as to bring the wrath of law enforcement down upon otherwise good people who drive a bit quickly.

Most of the law abiding, productive citizens in this state and others routinely exceed posted speed limits. Law enforcement should be used to protect them from violent criminals and common thieves, and there are few corners of this state where you would feel totally safe to leave your home or car unlocked when unattended. A government that cannot protect those it serves from demonstrable crimes against their liberty and property forfeits its claim on legitimacy. It is fair to say that government still has a ways to go toward its basic mission, and that most speeders have contributed nothing to the problem.

If the typical driver were truly endangering liberty and property, it would be visible to the naked eye, and wouldn't require radar surveillance to discern an infraction. There has never been a justification for the soft-core police state that passes for much of what we call 'traffic enforcement'. Police cars hiding by the side of the road, slinking around so as to nab people heading home from work too fast, should never have existed. Speed limit enforcement should be a low priority under the best of budget circumstances. And right now, when funding is tight, we should be redirecting those guys with radar guns toward the real predators who threaten our lives and wealth.

This proposal takes a bad policy and makes it worse. It raises the price of law enforcement without increasing its value, and undermines respect for law enforcement amongst the very people who should be its supporters."

While there is much merit to HB 4748, I voted no on final passage because it raises the filing fees to a rate that would severely compromise the ability of individuals to access the courts."

 

Rep. Anderson, having reserved the right to explain his protest against the passage of the bill, made the following statement:

"Mr. Speaker and members of the House:

I voted no on House Bill 4748(H-1) because it includes a fee increase that will be applied to people who are paying their child support. This fee increase would be used to create an entirely new fund for the Attorney General to spend for the purpose of child support enforcement. While I support any legitimate effort to improve child support collection, why should the people who are following the rules have to foot the bill so that the AG can try to collect money from people who aren't? This is patently unfair. Child support collections efforts are important, but we should either spread those costs among all of the people of this state or place them upon the wrongdoers. Those costs should not be borne solely by the people who are doing their level best to do right by their children. Payment of child support can be a significant cost in a person's life and we should not be making things worse for those people who are living up to their responsibilities and paying their child support."
