SENATE BILL No. 1297

A bill to amend 1975 PA 164, entitled

"An act to create a commission on Spanish-speaking affairs, an

office of Spanish-speaking affairs, and an interagency council on

Spanish-speaking affairs; to prescribe their powers and duties;

to provide for appropriations; and to abolish the advisory coun-

cil for the Spanish-speaking,"

by amending sections 2 and 4 (MCL 18.302 and 18.304).

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 2. (1) A commission on Spanish-speaking affairs is

2 established within the department of management and budget

3 CAREER DEVELOPMENT. The commission shall consist of 15 members

4 appointed by the governor by and with the advice and consent of

5 the senate. The commission shall elect a chairperson,

6 vice-chairperson, and other officers from its members as it deems

7 advisable.

8 (2) Members of the commission shall be Spanish-speaking and

9 of Spanish-speaking origin. Members shall be appointed from

1 urban, suburban, and rural geographical areas representative of

2 the Spanish-speaking people throughout this state.

3 (3) The term of each member shall be 3 years. Of the mem-

4 bers first appointed, 5 shall serve for 3-year terms, 5 shall

5 serve for 2-year terms, and 5 shall serve for a 1-year term. A

6 vacancy shall be filled by the governor in the same manner as the

7 original appointment for the balance of the unexpired term.

8 (4) The commission shall meet not less than 12 times during

9 each calendar year. Each member of the commission shall receive

10 per diem compensation as appropriated in the annual budget. Per

11 diem compensation shall be paid only for a full day's commission

12 work at which a quorum is present. A member shall receive reim-

13 bursement for actual and necessary traveling expenses incurred in

14 the performance of official business. Reimbursement shall be

15 made in the manner provided by law for state employees.

16 (5) A majority of the members of the commission constitutes

17 a quorum. A majority of the members of the commission is

18 required for final action by the commission. A vacancy in the

19 commission shall not impair the right of the remaining members to

20 exercise the powers of the commission.

21 Sec. 4. (1) The office of Spanish-speaking affairs is

22 established within the department of management and budget

23 CAREER DEVELOPMENT.

24 (2) The commission shall select the director of the office

25 with the concurrence of the director of the department of

26 management and budget CAREER DEVELOPMENT in accordance with

27 state civil service procedures.
