HOUSE BILL No. 6311 September 17, 2002, Introduced by Rep. Wojno and referred to the Committee on Family and Children Services. A bill to amend 1962 PA 60, entitled "An act to provide for the day parole of prisoners in county jails to permit them to be gainfully employed outside the jail or pursue other activities; to provide for the granting of reduc- tions in terms of imprisonment and the regulation thereof; and to provide for the disposition of earnings from such employment," by amending sections 2, 3, 4, and 6 (MCL 801.252, 801.253, 801.254, and 801.256). THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 2. The sheriff, or friend of thecourtCHILD in ali- 2 mony or nonsupport cases, shall collect the wages or salary of an 3 employed prisoner, or require him to turn over his wages or 4 salary in full when received. The officer shall deposit the same 5 in a trust checking account and keep a ledger showing the status 6 of the account of each prisoner. The wages or salary are not 7 subject to garnishment in the hands of the employer or the 8 officer during the prisoner's term. 07684'02 o GWH 2 1 Sec. 3. A gainfully employed prisoner is liable for the 2 cost of his OR HER board in the jail as fixed by the sheriff. If 3 necessarily absent from jail at a meal time,heTHE PRISONER 4 shall athisTHE PRISONER'S request be furnished with an ade- 5 quate nourishing lunch to carry to work. The sheriff or friend 6 of thecourtCHILD shall chargehisTHE PRISONER'S account, 7 ifhe has oneANY, for such board. If the prisoner is gain- 8 fully self-employed, he OR SHE shall pay the sheriff for such 9 board, in default of whichhisTHE PRISONER'S employment privi- 10 lege is automatically forfeited. If the jail food is furnished 11 directly by the county, the sheriff shall account for and pay the 12 board payments to the county treasurer. The board of supervisors 13 by ordinance may provide that the county furnish or pay for the 14 transportation of employed prisoners to and from their place of 15 employment. 16 Sec. 4. The sheriff or friend of thecourtCHILD shall 17 disburse the wages or salary of an employed prisoner for only the 18 following purposes in the order stated: 19 (a) Board of the prisoner.;20 (b) Necessary travel expense to and from work and other 21 incidental expenses of the prisoner.;22 (c) Support of the prisoner's dependents, if any.;23 (d) Payment, either in full or ratably, of the prisoner's 24 obligations, acknowledged by him in writing, or which have25beenTHAT THE PRISONER ACKNOWLEDGES IN WRITING OR THAT ARE 26 reduced to judgment.;07684'02 o 3 1 (e) The balance, if any, to the prisoner uponhisTHE 2 PRISONER'S discharge. 3 Sec. 6. The county department of social welfare shall at 4 the request of the court investigate and report to the sheriff or 5 friend of thecourtCHILD the amount necessary for support of 6 the prisoner's dependents. 7 Enacting section 1.
