HOUSE BILL No. 6104 May 21, 2002, Introduced by Reps. A bill to amend 1927 PA 372, entitled "An act to regulate and license the selling, purchasing, possess- ing, and carrying of certain firearms and gas ejecting devices; to prohibit the buying, selling, or carrying of certain firearms and gas ejecting devices without a license or other authoriza- tion; to provide for the forfeiture of firearms under certain circumstances; to provide for penalties and remedies; to provide immunity from civil liability under certain circumstances; to prescribe the powers and duties of certain state and local agen- cies; to prohibit certain conduct against individuals who apply for or receive a license to carry a concealed pistol; to make appropriations; to prescribe certain conditions for the appropri- ations; and to repeal all acts and parts of acts inconsistent with this act," (MCL 28.421 to 28.435) by adding section 5x. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 5X. (1) NOTWITHSTANDING ANY OTHER PROVISION OF THIS 2 ACT, A LAW ENFORCEMENT OFFICER MAY APPLY FOR AND BE ISSUED A LAW 3 ENFORCEMENT CONCEALED WEAPON LICENSE UNDER THIS SECTION. 4 (2) THE FOLLOWING PROVISIONS OF THIS ACT DO NOT APPLY TO A 5 LAW ENFORCEMENT CONCEALED WEAPON LICENSE: 06890'02 TLG 2 1 (A) THE FEE PROVISION OF SECTION 5B(5). 2 (B) THE REQUIREMENT THAT FINGERPRINTS BE TAKEN UNDER SEC- 3 TIONS 5B(9) AND 5l(1) FOR THE RENEWAL OF A LICENSE. 4 (C) SECTION 5N(3). 5 (D) SECTION 5o. 6 (3) A LAW ENFORCEMENT OFFICER MAY APPLY FOR A LAW ENFORCE- 7 MENT CONCEALED WEAPON PERMIT IN THE MANNER PROVIDED UNDER SECTION 8 5B ON FORMS PROVIDED BY THE DIRECTOR OF THE DEPARTMENT OF STATE 9 POLICE FOR THAT PURPOSE. 10 (4) A LAW ENFORCEMENT CONCEALED WEAPON PERMIT APPLICATION 11 SHALL BE EXPEDITED BY THE CONCEALED WEAPON LICENSING BOARD. 12 (5) AS USED IN THIS SECTION, "LAW ENFORCEMENT OFFICER" 13 INCLUDES, BUT IS NOT LIMITED TO, ALL OF THE FOLLOWING: 14 (A) A PAROLE OFFICER. 15 (B) A CORRECTIONS OFFICER. 16 (C) A CONSERVATION OFFICER. 17 (D) AN AUXILIARY, RESERVE, OR VOLUNTEER POLICE OFFICER, 18 WHETHER OR NOT PAID FOR HIS OR HER POLICE DUTIES. 19 (E) A PART-TIME POLICE OFFICER. 20 (F) A SHERIFF, OTHER THAN A DEPUTY SHERIFF. 21 (G) AN INVESTIGATOR FOR THIS STATE OR A POLITICAL SUBDIVI- 22 SION OF THIS STATE WHO IS AUTHORIZED TO CARRY A FIREARM IN THE 23 COURSE OF HIS OR HER DUTIES. 24 (H) A COURT OFFICER. 25 (I) AN INDIVIDUAL DESCRIBED IN SUBDIVISIONS (A) THROUGH (H) 26 WHO IS RETIRED FROM HIS OR HER LAW ENFORCEMENT DUTIES. 06890'02 Final page.
