A bill to amend 1956 PA 218, entitled "The insurance code of 1956," by amending section 3406h (MCL 500.3406h), as added by 1995 PA 237. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 3406h. (1) If a parent is eligible for dependent cov- 2 erage through an insurer, the insurer shall: 3 (a) Permit the parent to enroll, under the dependent cover- 4 age, a child who is otherwise eligible for coverage without 5 regard to any enrollment season restrictions. 6 (b) If the parent is enrolled but fails to make application 7 to obtain coverage for the child, enroll the child under depen- 8 dent coverage upon application by the friend of the court COURT 9 FAMILY SERVICES ADMINISTRATOR or by the child's other parent 10 through the friend of the court COURT FAMILY SERVICES OFFICE. 04605'01 i * DGB 2 1 (c) Not eliminate the child's coverage unless premiums have 2 not been paid as required by the policy or certificate or the 3 insurer is provided with satisfactory written evidence of either 4 of the following: 5 (i) The court or administrative order is no longer in 6 effect. 7 (ii) The child is or will be enrolled in comparable health 8 coverage through another insurer, health care corporation, health 9 maintenance organization, or self-funded health coverage plan 10 that will take effect not later than the effective date of the 11 cancellation of the existing coverage. 12 (2) If a child has health coverage through an insurer of a 13 noncustodial parent, that insurer shall do all of the following: 14 (a) Provide the custodial parent with information necessary 15 for the child to obtain benefits through that coverage. 16 (b) Permit the custodial parent or, with the custodial 17 parent's approval, the provider to submit a claim for covered 18 services without the noncustodial parent's approval. 19 (c) Make payment on claims submitted under subdivision (b) 20 directly to the custodial parent or medical provider. 21 (3) This section applies only if a parent is required by a 22 court or administrative order to provide health coverage for a 23 child and the insurer is notified of that court or administrative 24 order. 25 Enacting section 1.
