A SUMMARY OF HOUSE BILL 6104 AS INTRODUCED 5-21-02

House Bill 6140 would amend the handgun licensure act, which regulates the carrying of concealed weapons, to add provisions allowing law enforcement officers to apply for and be issued a law enforcement concealed weapon license. An officer would apply for the license on the standard concealed weapon application form but would not have to pay the application fee. Unlike others who apply for and obtain a concealed weapon license, law enforcement officers would not have to have their fingerprints be taken for license renewal and would not be subject to restrictions on where a concealed weapon may be taken. Also, a police agency could not prevent a law enforcement officer from carrying a concealed pistol, despite any effect that doing so might have on the agency's insurance premiums or coverage. Finally, the bill would direct the concealed weapon licensing board to expedite applications for law enforcement concealed weapon licenses.

The bill contains a list of persons who qualify as "law enforcement officer" applying only to the proposed provisions, including all of the following: a parole officer; a corrections officer; a conservation officer; an auxiliary, reserve, or volunteer police officer, whether paid or unpaid; a part-time police officer; a sheriff, other than a deputy sheriff; an investigator for the state or a political subdivision of the state who is authorized to carry a firearm in the course of his or her duties; a court officer; and an individual who is retired from any such law enforcement position or duties. (Under current law, "peace officers" who are regularly employed and paid by the federal government, the state, or a local government are exempt from the act's requirement to obtain a concealed weapon license.)
