CONSUMER PROTECTION ACT: TELEMARKETER VIOLATIONS

House Bill 4632

Sponsor: Rep. Irma Clark

Committee: Energy and Technology

Complete to 4-24-01

A SUMMARY OF HOUSE BILL 4632 AS INTRODUCED 4-19-01

Among other things, under the Michigan Consumer Protection Act "unfair, unconscionable, or deceptive methods, acts, or practices" in the conduct of trade or commerce are unlawful. The act defines such acts by listing them.

The bill would amend the act to make violations of the home solicitation sales act (Public Act 227 of 1971) in connection with a home solicitation sale or telephone solicitation an unfair practice, and, therefore, illegal and punishable by remedies provided by the consumer protection act (which include civil penalties and actual damages or $250 per violation, whichever is greater, plus reasonable attorney fees).
