Rev. D. L. Bradley, Pastor of Bethlehem Temple Apostolic Faith Church in Mt. Clemens, offered the following invocation:

 

"O Lord, Your voice has thundered down from heaven to men saying, 'blessed is the nation whose God is the Lord; and the people whom He hath chosen for His own inheritance.' You have let it be known that the assembling of just such a representative body as this should understand and fulfill Your word which states, 'in multitude of counselors there is safety.'

Today we are assembled at this opening session of this Michigan House of Representatives. We pray that wisdom course through this place--that this House will let judgment run down as waters, and righteousness as a mighty stream.

We pray that every Representative here fully understand that they are here by the will of God. For it is You, O Most High, who ruleth in the kingdom of men, and giveth it to whomsoever He will. It is You, O Most High, who ruleth in the kingdom of men, and giveth it to whomsoever He will, and setteth up over it the baseth of men.

Though we are a republic, though this is the House of Representatives, cause every Representative to know that the powers that be are ordained of God. Though a vote was cast, though an election was won, still, the powers that be are ordained of God.

By this prayer, cause every Representative to know this. By this prayer, cause every Representative to understand that the eyes of the Lord are ever looking upon the affairs of men.

Now, Lord, and because of this prayer, bless this place. Bless these representatives. Bless them as they deliberate over the peoples' business. And, when the business of this session is complete, when the sun has set and the baton is to be passed to all who will come after, let it be said that this session of the House of Representatives conducted the business of the people of Michigan in a way that was well-pleasing in the sight of God.

Hear this prayer, O Lord. Answer it, O Savior. Bestow Your blessings upon this place. In Jesus' name, I pray. Amen."

Motions and Resolutions

The Speaker, on behalf of the entire membership of the House of Representatives, offered the following resolution:

House Resolution No. 74.

A resolution of tribute offered as a memorial for Jerry C. Bartnik.

Whereas, The members of this legislative body and people throughout this state who shared his love of Michigan's outdoors were saddened to learn of the passing of Jerry C. Bartnik. As a local official in Monroe County, as a five-term legislator, as a vital member of the Natural Resources Commission since 1993, and as a champion of our state's hunting and fishing heritage, Jerry Bartnik had a lasting positive impact on Michigan; and

Whereas, A graduate of Bowling Green State University in Ohio who earned his master's degree from Western Michigan University, Jerry Bartnik devoted himself to service throughout his life. His commitment was reflected in his leadership in Monroe County government as a county commissioner, as chairman of the county board of health, and as a member of the road commission. These public-sector responsibilities blended well with his involvement in numerous community groups; and

Whereas, Jerry Bartnik brought his experiences and energies to Lansing in 1983 as a member of the House of Representatives. As a lawmaker, Representative Bartnik was a strong and articulate voice on conservation and recreation issues and an advocate of Second Amendment rights. He was especially effective in his committee assignments and distinguished himself as chair of the Tourism, Fisheries, and Wildlife Committee; and

Whereas, Following his legislative tenure, Mr. Bartnik channeled his talents to his duties as a member of the Michigan Natural Resources Commission. In this role, he was an energetic proponent of the interests of those who shared his love for the outdoors. Fittingly, even as he fought his own personal battle with illness in recent years, he never stopped battling for hunters' rights. This legacy will long be treasured by many in our state; now, therefore, be it

Resolved by the House of Representatives, That we offer this expression of our highest tribute to honor the memory of Jerry C. Bartnik, a member of this legislative body from 1983 to 1992; and be it further

Resolved, That copies of this resolution be transmitted to the Bartnik family as evidence of our deepest condolences.

A resolution to memorialize the Congress of the United States to increase funding under the Individuals with Disabilities Education Act.

Whereas, The Individuals with Disabilities Education Act (IDEA) requires the states to provide education and related services to all students with disabilities. This legislation, which was initially enacted in 1975 as the Education for All Handicapped Children Act, established a goal of federal spending at 40 percent of the costs. In reality, federal spending has fallen woefully short of this threshold, with actual federal funding near 12 percent; and

Whereas, While great progress has been made in the area of special education, it is clear that more needs to be done. Of particular concern are the indications that the percentage of students with disabilities is rising and the impact of recent court rulings on which medically related services need to be provided under federal law; and

Whereas, Without a significantly greater federal commitment, the increasing costs of special education funding are likely to be met only at the expense of general education. More than 6 million children today are identified as having a disability under IDEA, compared with 1 million when the law was enacted. The resources of any state, including Michigan, will not be able to meet the needs of these students without a substantial increase in support from the federal government; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the Congress of the United States to increase funding under the Individuals with Disabilities Education Act; and be it further

House Resolution No. 72.

A resolution to memorialize the Congress of the United States to enact legislation to permit the states to regulate and prohibit the importation of solid waste.

Whereas, The citizens of Michigan are very concerned about reports of trash being imported from Canada for disposal here. Our state and local communities have taken steps to try to protect our natural resources through many measures, including efforts to make solid waste landfills as safe as possible. Our citizens recognize that landfill capacity is limited and that this capacity is, in effect, a valuable resource as well; and

Whereas, Michigan has attempted to regulate the importation of trash, but state laws on this were ruled unconstitutional by the United States Supreme Court in 1992. The nation's highest court found that solid waste transportation was business activity protected by federal authority over interstate commerce. As a result, congressional actions are necessary before Michigan or any other state can take actions to regulate the importation of solid waste; and

Whereas, Without the authority to regulate or prohibit the importation of solid waste, a state is seriously hampered in its ability to protect its environment. Even under the best controls, a solid waste landfill holds long-term risks, especially to water resources. Clearly, the importation of solid waste is far more than an issue of commerce. It is an issue of health and safety that the states need to be able to address. This should be clarified by appropriate federal legislation; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the Congress of the United States to enact legislation to permit the states to regulate and prohibit the importation of solid waste; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

A resolution congratulating Mr. Bill Stewart for his proposal of "Let there be Lights".

Whereas, Mr. Bill Stewart of St. Clair Shores is proposing the use of "Little White Lights" and "porch lights" to brighten our communities by encouraging citizens and businesses to keep white lights lit through the winter months; and

Whereas, All Michiganians appreciate the concept of safe neighborhoods. The indirect illumination that the lights provide promotes pedestrian safety. Lights will build a united community in our neighborhoods and our homes; and

Whereas, Lights create a feeling of therapeutic harmonization to the young and old. The months of January, February, and March have some of the longest and coldest nights. The extension of white lights support the feeling of brotherly love; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body accept the concept of and congratulate Mr. Bill Stewart for his proposal on the use of "Little White Lights" and "porch lights". We urge all Michiganians to consider the use of "Little White Lights" in the months of January, February, and March; and be it further

Resolved, That a copy of this resolution be transmitted to Mr. Bill Stewart as evidence of our best wishes for the future.

House Resolution No. 75.

A resolution honoring Art LeTourneau upon his selection for community recognition.

Whereas, It is a great honor and a distinct privilege to join with well-wishers and the Midland-Gladwin Community Mental Health Board on the evening of April 19, 2001 in saluting Art LeTourneau as he is most deservedly recognized at their annual meeting. The creation of the "Art LeTourneau Award" for creative thinking and cooperative action across agency lines in order to achieve excellence is in honor of Art's great commitment. The award will be given annually to an individual, group, or organization that reflects Art's creative initiatives, spirit, and vision of a better life for people with developmental disabilities. This recognition is a formal acknowledgment of something many of us have known for a long while, Art exemplifies the finest qualities in his service to the community. His hard work, commitment, and unique ability to infuse others with his own brand of enthusiasm have inspired hundreds of co-workers and members of the community to become more educated and involved adults since 1989 when he became Associate Director of Services for People with Developmental Disabilities; and

Whereas, This recognition is rightfully given to an individual whose primary responsibility is direct care and concern, along with significant contributions to enhance the quality of life for people he comes into contact with. We congratulate Art for his vision of a better life for people with developmental disabilities, his innovation in collaborating with individuals, their families, and other agencies to create Supported Community Living Options in Midland, and his collaboration with consumers, parents, and other agencies to create a shared purpose; and

Whereas, In 2001, more than 150 individuals with disabilities in Midland live in homes of their own, with the opportunity to select and control the services they receive from the mental health system and with full membership in the community. Without Art's leadership, the collaborative spirit that energized the development of the supported community living, this could not have happened. Around the state of Michigan, other community mental health organizations are looking to Art's example as a way to achieve similar opportunities for people with disabilities in their communities. The field of developmental disabilities has embraced the principles and practices that Art has championed. People with disabilities all around Michigan have the opportunity for a better quality of life thanks to the work of Art LeTourneau; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body join in honoring Art LeTourneau upon his selection for community recognition; and be it further

Resolved, That a copy of this resolution be transmitted to Art LeTourneau as a token of our respect for his fine work.

House Resolution No. 76.

A resolution to urge the Michigan Department of Education to extend the period for public comment and response on proposed new administrative rules on special education services.

Whereas, On March 5, 2001, the Michigan Department of Education published proposed new administrative rules on special education programs and services. These rules encompass nearly 150 pages on matters that are of great importance to Michigan families with students in need of some special education services. In spite of the complexity and length of the new regulations, the public comment period is scheduled to close on April 16, 2001; and

Whereas, The brief window for public comment on the proposed rules is far too short for people to gain a grasp of the new special education rules. Educators, advocacy groups, and individual families with children receiving these services have expressed frustration with the inadequate time to understand the changes of the new regulations in an area of services that is by nature quite complex and challenging; and

Whereas, The development of the new rules has taken several years and represents sweeping changes in the delivery of services. The changes also may involve major shifts in the administration of special education programs. To hasten this part of a complex process at the critical juncture of gaining public understanding and comment is poor public policy. It will surely not foster the public support that is essential to making any law or regulation as effective as it can be; now, therefore, be it

Resolved by the House of Representatives, That we urge the Michigan Department of Education to extend the period for public comment and response on proposed new administrative rules on special education services; and be it further

Resolved, That copies of this resolution be transmitted to the Office of Regulatory Reform, the Superintendent of Public Instruction, and the members of the Michigan Board of Education.
