A bill to amend 1980 PA 299, entitled
"Occupational code,"
by amending section 203 (MCL 339.203), as amended by 1988
PA 463.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 203. (1) The department may issue a license or regis-
2 tration to a person pursuant to a specific article, if the person
3 demonstrates to the satisfaction of the department and a board
4 that the licensure or registration requirements do not constitute
5 a fair and adequate measure of the person's knowledge and skills
6 or that a required examination for receipt of a license or regis-
7 tration does not serve as an adequate basis for determining
8 whether a person could perform an occupation with competence.

10 director and a board is prescribed in

under this section until the
person pays the appropriate
3 fees as prescribed in article 4.
4 (2) A license or registration issued under this article may
5 be issued with a limitation. The department shall notify the
6 appropriate board of the department's intent to impose a limita-
7 tion on the issuance of a license or registration of a person
8 seeking a license or registration in the occupation for which the
9 board serves. The department may impose the limitation only with
10 the approval of the notified board. However, if the notified
11 board, within 60 days after receipt of the notification by the
12 department, neither approves nor disapproves the imposition of a
13 limitation, the department may impose the limitation. A person
14 who receives a license or registration with a limitation may
15 receive a review of the limitation as provided in section 519.
16 (3) Notwithstanding
any other
provision of this act, a
17 person licensed,
registered, or
certified under an act repealed
18 by this act to practice an
occupation on
the day immediately pre-
19 ceding the effective date
of this act
shall be considered to be
20 appropriately licensed,
registered, or
certified under this act
21 until the expiration of
the licensure,
registration, or certifi-
22 cation granted under the
repealed act
THE PROVISIONS CONTAINED
23 IN ANY ARTICLE, THE DEPARTMENT SHALL GRANT A LICENSE TO ENGAGE IN
24 A PARTICULAR OCCUPATION OR A REGISTRATION TO USE A PARTICULAR
25 TITLE TO AN APPLICANT LICENSED, REGISTERED, OR OTHERWISE REGU-
26 LATED IN THE PROVINCE OF ONTARIO, COMMONWEALTH OF CANADA, BY AN
27 EQUIVALENT LICENSING BOARD OR REGULATORY AUTHORITY SO LONG AS

1 THAT LICENSING BOARD OR REGULATORY AUTHORITY GRANTS RECIPROCITY
2 TO INDIVIDUALS WHO ARE LICENSED OR REGISTERED UNDER THIS ACT.
