A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending section 20131 (MCL 333.20131).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 20131. (1) The department shall establish a comprehen-
2 sive system of licensure and certification for health facilities
3 or agencies in accordance with this article to ACCOMPLISH ALL OF
4 THE FOLLOWING:
5 (a) Protect the health, safety, and welfare of individuals
6 receiving care and services in or from a health facility or
7 agency.
8 (b) Assure the medical accountability for reimbursed care
9 provided by a certified health facility or agency participating
10 in a federal or state health program.

1 (2) The department may certify a health facility or agency,
2 or part thereof
OF A HEALTH FACILITY
OR AGENCY, AS defined in
3 section 20106 or under section
20115,
when IF certification is
4 required by state or federal law, rule, or regulation.
5 (3) The department shall coordinate all functions in state
6 government affecting health facilities and agencies licensed
7 under this article and cooperate with other state agencies
8 which
THAT establish standards or
requirements for health
9 facilities and agencies to assure necessary, equitable, and con-
10 sistent state supervision of licensees without unnecessary dupli-
11 cation of survey, evaluation, and consultation services or com-
12 plaint investigations. The department may enter into agreements
13 with other state agencies necessary to accomplish this purpose.
14 (4) THE DEPARTMENT OF CONSUMER AND INDUSTRY SERVICES, TO THE
15 EXTENT FEASIBLE, SHALL WORK IN COOPERATION AND CONSULTATION WITH
16 THE DEPARTMENT OF COMMUNITY HEALTH, THE ATTORNEY GENERAL, AND THE
17 STATE LONG-TERM CARE OMBUDSMAN IN THE LICENSING AND REGULATION OF
18 NURSING HOMES.

utilize public disclosure to
20 improve the effectiveness of licensure.
