A bill to amend 1995 PA 266, entitled

"An act to authorize and regulate credit card transactions

involving local units of government, including the use of credit

cards by officers and employees of local units of government; and

to provide for powers and duties of certain state and local agen-

cies, officers, and employees,"

by amending section 1 (MCL 129.241).

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 1. As used in this act:

2 (a) "Budget" means a plan of financial operation for a given

3 period of time, including an estimate of all proposed expendi-

4 tures from the funds of a local unit and the proposed means of

5 financing the expenditures. As used in section 4(1), budget does

6 not include any of the following:

7 (i) A fund for which the local unit acts as a trustee or

8 agent.

1 (ii) An intragovernmental service fund.

2 (iii) An enterprise fund.

3 (iv) A public improvement or building and site fund.

4 (v) A special assessment fund.

5 (b) "Credit card" means a card or device issued under a

6 credit card arrangement by a person licensed under Act No. 379

7 of the Public Acts of 1984, being sections 493.101 to 493.114 of

8 the Michigan Compiled Laws 1984 PA 379, MCL 493.101 TO 493.114,

9 by a person licensed under the consumer financial services act,

10 Act No. 161 of the Public Acts of 1988, being sections 487.2051

11 to 487.2072 of the Michigan Compiled Laws 1988 PA 161, MCL

12 487.2051 TO 487.2072, or by a depository financial institution as

13 definition DEFINED IN section 1a of the mortgage brokers, len-

14 ders, and servicers licensing act, Act No. 173 of the Public

15 Acts of 1987, being section 445.1651a of the Michigan Compiled

16 Laws 1987 PA 173, MCL 445.1651A.

17 (c) "Credit card arrangement" means an unsecured extension

18 of credit for purchasing goods or services from the credit card

19 issuer or any other person that is made to the holder of a credit

20 card and that is accessed with a credit card.

21 (d) "Credit card policy" means a policy adopted by resolu-

22 tion of a local unit under section 3.

23 (e) "Governing body" means any of the following:

24 (i) The council, commission, or other entity vested with the

25 legislative power of a village.

26 (ii) The council or other entity vested with the legislative

27 power of a city.

1 (iii) The township board of a township.

2 (iv) The county board of commissioners of a county.

3 (v) The board of county road commissioners of a county.

4 (vi) The board of education of a local school district.

5 (vii) The board of education of an intermediate school

6 district.

7 (viii) The board of trustees of a community college

8 district.

9 (ix) The official body to which is granted general governing

10 powers over an authority or organization of government estab-

11 lished by law which THAT may issue obligations pursuant to Act

12 No. 202 of the Public Acts of 1943 UNDER THE MUNICIPAL FINANCE

13 ACT, 1943 PA 202, MCL 131.1 TO 139.3, and which THAT may expend

14 funds of the authority or organization.

15 (x) A COMMUNITY MENTAL HEALTH AUTHORITY CREATED UNDER

16 SECTION 205 OF THE MENTAL HEALTH CODE, 1974 PA 258, MCL 330.1205.

17 (f) "Local school district" means a school district orga-

18 nized under the REVISED school code, of 1976, Act No. 451 of the

19 Public Acts of 1976, being sections 380.1 to 380.1852 of the

20 Michigan Compiled Laws 1976 PA 451, MCL 380.1 TO 380.1852, or a

21 district governed by a special or local act.

22 (g) "Local unit" means any of the following:

23 (i) A village.

24 (ii) A city.

25 (iii) A township.

26 (iv) A county.

1 (v) A county road commission.

2 (vi) A local school district.

3 (vii) An intermediate school district.

4 (viii) A community college district.

5 (ix) An authority or organization of government established

6 by law which THAT may issue obligations pursuant to Act

7 No. 202 of the Public Acts of 1943 UNDER THE MUNICIPAL FINANCE

8 ACT, 1943 PA 202, MCL 131.1 TO 139.3, and which THAT may expend

9 funds of the authority or organization.

10 (x) A COMMUNITY MENTAL HEALTH AUTHORITY CREATED UNDER

11 SECTION 205 OF THE MENTAL HEALTH CODE, 1974 PA 258, MCL 330.1205.
