A bill to amend 1974 PA 300, entitled "Motor vehicle service and repair act," by amending section 4 (MCL 257.1304), as amended by 1980 PA 151. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 4. (1) Unless the act or practice of repairing, serv- 2 icing, reconditioning, or engaging in the activity of a master 3 MECHANIC or specialty mechanic is adopted for the purposes of 4 evading this act, this act shall DOES not apply to a person who 5 DOES ANY OF THE FOLLOWING: 6 (a) Repairs, replaces, reconditions, adjusts, analyzes, 7 diagnoses, or alters the operating condition of his or her own or 8 a family member's motor vehicle and for which there is evidence 9 of ownership of that motor vehicle. 10 (b) Is a master or MECHANIC, specialty mechanic, a motor 11 vehicle mechanic, a mechanic trainee, or technician who is in 04163'99 LBO 2 1 the full-time employ of an automotive manufacturer and is engaged 2 solely in that capacity on motor vehicles owned by or being 3 produced by the manufacturer. 4 (c) Engages solely in the business of repairing the motor 5 vehicles for compensation of a single commercial, industrial, or 6 governmental establishment, or 2 or more establishments related 7 by common ownership or corporate affiliation. 8 (d) Engages solely in the business of repairing, replacing, 9 reconditioning, adjusting, analyzing, diagnosing, or altering the 10 operating condition of a motor vehicle or trailer not required to 11 be registered and not titled under Act No. 300 of the Public 12 Acts of 1949, as amended, being sections 257.1 to 257.923 of the 13 Michigan Compiled Laws THE MICHIGAN VEHICLE CODE, 1949 PA 300, 14 MCL 257.1 TO 257.923. The state treasurer shall reimburse a 15 person exempted under this subdivision money paid by the person 16 as a registration fee or renewal registration fee under section 17 30. 18 (2) AN INDIVIDUAL ENGAGED, FOR COMPENSATION, IN THE REPAIR 19 OF A MOTOR VEHICLE MANUFACTURED BEFORE 1970 OR THE RECONDITION- 20 ING, REPLACEMENT, ADJUSTMENT, OR ALTERATION OF THE OPERATING CON- 21 DITION OF ANY COMPONENT OR SUBASSEMBLY OF A MOTOR VEHICLE MANU- 22 FACTURED BEFORE 1970 IS NOT REQUIRED TO BE CERTIFIED AS A 23 MECHANIC SO LONG AS THE REPAIR OCCURS IN A REGISTERED MOTOR VEHI- 24 CLE FACILITY. 04163'99 Final page.
