A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending sections 803l and 804 (MCL 257.803l and 257.804), section 803l as amended by 1998 PA 68 and section 804 as amended by 1995 PA 129, and by adding sections 6d, 17b, 30b, 811d, 811e, 811f, 811g, and 811h; and to repeal acts and parts of acts. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 SEC. 6D. "COLLECTOR PLATE" MEANS A PLATE THAT CONTAINS A 2 REPRODUCTION OF EVERY CHARACTERISTIC OF A SPECIFIC REGISTRATION 3 PLATE EXCEPT FOR THE NUMBER AND LETTER CHARACTERS, WHICH SHALL BE 4 DETERMINED BY THE SECRETARY OF STATE, AND THAT IS SOLD AS 5 DESCRIBED IN SECTION 811G. A COLLECTOR PLATE IS NOT A REGISTRA- 6 TION PLATE. 7 SEC. 17B. "FUND-RAISING REGISTRATION PLATE" MEANS A 8 REGISTRATION PLATE THAT CONTAINS A DESIGN OR LOGO REPRESENTING A 03790'99 TLG 2 1 SYMBOL FOR A MICHIGAN UNIVERSITY OR STATE-SPONSORED GOAL AND IS 2 ISSUED BY THE SECRETARY OF STATE TO RAISE FUNDS FOR THE RESPEC- 3 TIVE MICHIGAN UNIVERSITY OR STATE-SPONSORED GOAL. AS USED IN 4 THIS SECTION, "STATE-SPONSORED GOAL" MEANS THE PURPOSE FOR WHICH 5 A STATE-SPONSORED FUND-RAISING REGISTRATION PLATE IS AUTHORIZED 6 UNDER SECTION 811E. 7 SEC. 30B. "MICHIGAN UNIVERSITY" MEANS ANY OF THE FOLLOWING 8 INSTITUTIONS OF HIGHER EDUCATION: 9 (A) CENTRAL MICHIGAN UNIVERSITY. 10 (B) EASTERN MICHIGAN UNIVERSITY. 11 (C) FERRIS STATE UNIVERSITY. 12 (D) GRAND VALLEY STATE UNIVERSITY. 13 (E) LAKE SUPERIOR STATE UNIVERSITY. 14 (F) MICHIGAN STATE UNIVERSITY. 15 (G) MICHIGAN TECHNOLOGICAL UNIVERSITY. 16 (H) NORTHERN MICHIGAN UNIVERSITY. 17 (I) OAKLAND UNIVERSITY. 18 (J) SAGINAW VALLEY STATE UNIVERSITY. 19 (K) UNIVERSITY OF MICHIGAN - ANN ARBOR. 20 (l) UNIVERSITY OF MICHIGAN - DEARBORN. 21 (M) UNIVERSITY OF MICHIGAN - FLINT. 22 (N) WAYNE STATE UNIVERSITY. 23 (O) WESTERN MICHIGAN UNIVERSITY. 24 Sec. 803l. (1) A person who was a member of the armed serv- 25 ices during World War II may make application to the secretary of 26 state for a special registration plate, which shall display an 27 appropriate vignette preceding the registration numbers and shall 03790'99 3 1 have the word "veteran" inscribed beneath the registration 2 numbers. 3 (2) Application for a special registration plate shall be on 4 a form prescribed by the secretary of state, and shall be accom- 5 panied by any proof of the applicant having been a World War II 6 veteran, which the secretary of state may require. The applica- 7 tion for a special registration plate shall also be accompanied 8 with payment of a $5.00 service fee. 9 (3) Upon proper application and payment of the $5.00 service 10 fee, the secretary of state shall issue 1 or more special reg- 11 istration plates PLATE for each applicant for use on a passen- 12 ger vehicle. A person who is disabled who makes application for 13 a special registration plate under this section and who makes 14 payment of the $5.00 service fee shall be issued a tab for per- 15 sons with disabilities as provided in section 803f for his or her 16 special registration plate. The secretary of state shall require 17 the same proof that the applicant is a disabled person as is 18 required for issuance of a permanent windshield placard under 19 section 675. A person issued 1 or more A special registration 20 plates PLATE under subsection (1) shall be assessed the appli- 21 cable tax provided in section 801. 22 (4) The use of a special registration plate on a vehicle 23 other than the vehicle for which the plate is issued, or by a 24 person who does not qualify under this section, is a 25 misdemeanor. 26 (5) The special registration plate issued under this section 27 shall expire on the birthday of the vehicle owner. When new 03790'99 4 1 plates are issued by the secretary of state, application for 2 renewal of the special registration plate shall be accompanied by 3 a $5.00 service fee. The applicant shall not be required to fur- 4 nish the proof provided in subsection (2). 5 Sec. 804. A fee of $5.00 shall be paid with each applica- 6 tion for a duplicate or replacement license plate provided for in 7 section 229. A fee of $10.00 shall be paid with each application 8 for a duplicate or replacement set of plates provided for in sec- 9 tion 803m. In addition to any other fees required under this 10 act, a $5.00 service fee shall be paid with each application for 11 each distinctive or commemorative plate provided for in this act 12 to cover manufacturing and issuance costs unless these costs are 13 otherwise specifically provided for in this act. EACH APPLICANT 14 FOR A DUPLICATE OR REPLACEMENT LICENSE PLATE PROVIDED FOR IN THIS 15 ACT SHALL PAY THE FOLLOWING FEE TO THE SECRETARY OF STATE, IN 16 ADDITION TO ANY OTHER FEES REQUIRED UNDER THIS ACT: 17 (A) FIVE DOLLARS FOR A STANDARD OR GRAPHIC STANDARD PLATE, 18 PERSONALIZED REGISTRATION PLATE, VETERANS SPECIAL REGISTRATION 19 PLATE, OR OTHER REGISTRATION PLATE FOR WHICH THE DUPLICATE OR 20 REPLACEMENT FEE HAS NOT BEEN SPECIFIED IN THIS ACT. 21 (B) TEN DOLLARS FOR A SET OF PLATES PROVIDED FOR IN SECTION 22 803M. 23 (C) TEN DOLLARS FOR EACH DISTINCTIVE OR COMMEMORATIVE REGIS- 24 TRATION PLATE ISSUED UNDER SECTION 225, FUND-RAISING REGISTRATION 25 PLATE ISSUED UNDER SECTION 811E OR 811F, OR COLLECTOR PLATE 26 DESCRIBED IN SECTION 811G. 03790'99 5 1 SEC. 811D. A FUND-RAISING REGISTRATION PLATE SERIES SHALL 2 CONTAIN ALL OF THE FOLLOWING AS PRESCRIBED OR APPROVED BY THE 3 SECRETARY OF STATE: 4 (A) THE SAME GENERIC BACKGROUND. 5 (B) LETTERS AND NUMBERS, EXCEPT A PERSONALIZED FUND-RAISING 6 REGISTRATION PLATE SHALL CONTAIN NOT MORE THAN 5 LETTER OR NUMBER 7 CHARACTERS. 8 (C) THE WORD "MICHIGAN" AND ANY OTHER UNIQUE IDENTIFIER 9 SPECIFIED BY THE SECRETARY OF STATE. 10 (D) A DESIGN OR LOGO. 11 SEC. 811E. (1) THE SECRETARY OF STATE MAY DEVELOP A 12 MICHIGAN UNIVERSITY FUND-RAISING REGISTRATION PLATE AS DESCRIBED 13 IN THIS SECTION, AND A MATCHING MICHIGAN UNIVERSITY COLLECTOR 14 PLATE AS DESCRIBED IN SECTION 811G. 15 (2) THE SECRETARY OF STATE MAY DEVELOP 1 OR MORE LIMITED 16 TERM REGISTRATION PLATES TO RECOGNIZE A STATE-SPONSORED EVENT, A 17 MICHIGAN UNIVERSITY, OR AN ACCOMPLISHMENT OR OCCASION OF A 18 MICHIGAN UNIVERSITY. 19 (3) THE SECRETARY OF STATE MAY, AT ANY 1 TIME, DEVELOP NOT 20 MORE THAN 6 DIFFERENT STATE-SPONSORED FUND-RAISING REGISTRATION 21 PLATES AS DESCRIBED IN THIS SECTION, AND MATCHING STATE-SPONSORED 22 COLLECTOR PLATES AS DESCRIBED IN SECTION 811G. AS USED IN THIS 23 SECTION, "STATE-SPONSORED FUND-RAISING REGISTRATION PLATE" MEANS 24 A FUND-RAISING REGISTRATION PLATE AUTHORIZED BY A PUBLIC ACT TO 25 RAISE FUNDS FOR A STATE-SPONSORED GOAL. THE PUBLIC ACT SHALL, AT 26 A MINIMUM, DO ALL OF THE FOLLOWING: 03790'99 6 1 (A) IDENTIFY THE PURPOSE OF THE STATE-SPONSORED FUND-RAISING 2 REGISTRATION PLATE. 3 (B) CREATE A FUND OR DESIGNATE AN EXISTING FUND TO RECEIVE 4 THE MONEY RAISED THROUGH THE SALE OF STATE-SPONSORED FUND-RAISING 5 REGISTRATION PLATES AND MATCHING COLLECTOR PLATES. 6 (C) IF A FUND IS CREATED, NAME THE PERSON OR ENTITY RESPON- 7 SIBLE FOR ADMINISTERING THE FUND. 8 (4) THE SECRETARY OF STATE MAY DEVELOP, PROMOTE, AND MARKET 9 THE FUND-RAISING REGISTRATION PLATES AND MATCHING COLLECTOR 10 PLATES ISSUED UNDER THIS SECTION WITH THE FUNDS AVAILABLE THROUGH 11 SERVICE FEES. 12 (5) IF THE DESIGN OR LOGO OF A MICHIGAN UNIVERSITY 13 FUND-RAISING REGISTRATION PLATE OR A STATE-SPONSORED FUND-RAISING 14 REGISTRATION PLATE USES 1 OR MORE DESIGNS, TRADE NAMES, TRADE- 15 MARKS, SERVICE MARKS, EMBLEMS, SYMBOLS, OR OTHER IMAGES THAT ARE 16 OWNED BY THE MICHIGAN UNIVERSITY THAT IS REQUESTING THE MICHIGAN 17 UNIVERSITY FUND-RAISING PLATE, THE PERSON OR ENTITY THAT IS SPON- 18 SORING A STATE-SPONSORED FUND-RAISING PLATE, OR ANY OTHER PERSON 19 OR ENTITY, THE MICHIGAN UNIVERSITY OR SPONSORING PERSON OR ENTITY 20 SHALL GRANT TO OR OBTAIN FOR THE SECRETARY OF STATE BOTH OF THE 21 FOLLOWING: 22 (A) A NONEXCLUSIVE WORLDWIDE LICENSE TO USE THOSE DESIGNS, 23 TRADE NAMES, TRADEMARKS, SERVICE MARKS, EMBLEMS, SYMBOLS, OR 24 OTHER IMAGES ON AND IN CONJUNCTION WITH THE MARKETING, PROMOTION, 25 SALE, OR COPYRIGHTING OF THE REGISTRATION PLATE OR IMAGE OF THE 26 REGISTRATION PLATE. 03790'99 7 1 (B) THE AUTHORITY TO MERCHANDISE THE REGISTRATION PLATE OR 2 AN IMAGE OF THE REGISTRATION PLATE. 3 (6) IN USING OR EMPLOYING A DESIGN, TRADE NAME, TRADEMARK, 4 SERVICE MARK, EMBLEM, SYMBOL, LOGO, OR OTHER IMAGE ON AND IN CON- 5 JUNCTION WITH THE MARKETING, PROMOTION, SALE, COPYRIGHTING, OR 6 MERCHANDISING OF A REGISTRATION PLATE OR IMAGE OF THE REGISTRA- 7 TION PLATE, THE SECRETARY OF STATE MAY ALTER THE SIZE OF THE 8 DESIGN, TRADE NAME, TRADEMARK, SERVICE MARK, EMBLEM, SYMBOL, 9 LOGO, OR OTHER IMAGE BUT SHALL NOT CHANGE THE COLOR OR DESIGN OF 10 THE DESIGN, TRADE NAME, TRADEMARK, SERVICE MARK, EMBLEM, SYMBOL, 11 LOGO, OR OTHER IMAGE WITHOUT THE PRIOR WRITTEN CONSENT OF THE 12 RESPECTIVE MICHIGAN UNIVERSITY OR SPONSORING PERSON OR ENTITY. 13 THE SECRETARY OF STATE SHALL NOT USE OR EMPLOY A DESIGN, TRADE 14 NAME, TRADEMARK, SERVICE MARK, EMBLEM, SYMBOL, LOGO, OR OTHER 15 IMAGE ON AND IN CONJUNCTION WITH THE MARKETING, PROMOTION, SALE, 16 COPYRIGHTING, OR MERCHANDISING OF A REGISTRATION PLATE OR AN 17 IMAGE OF THE REGISTRATION PLATE IN ANY MANNER THAT IS OFFENSIVE 18 TO THE MICHIGAN UNIVERSITY OR SPONSORING PERSON OR ENTITY THAT 19 COMPLIES WITH SUBSECTION (5). 20 (7) AS USED IN THIS SECTION, "MICHIGAN UNIVERSITY 21 FUND-RAISING REGISTRATION PLATE" MEANS A FUND-RAISING REGISTRA- 22 TION PLATE THAT IS ISSUED UNDER THIS SECTION AT THE REQUEST OF A 23 MICHIGAN UNIVERSITY. 24 SEC. 811F. (1) THE SECRETARY OF STATE MAY, UPON APPLICA- 25 TION, ISSUE 1 FUND-RAISING REGISTRATION PLATE INSTEAD OF A STAN- 26 DARD REGISTRATION PLATE TO A PERSON FOR USE ON A PASSENGER MOTOR 27 VEHICLE OR MOTOR HOME OR A PICKUP TRUCK OR VAN USED EXCLUSIVELY 03790'99 8 1 TO TRANSPORT PERSONAL POSSESSIONS OR FAMILY MEMBERS FOR 2 NONBUSINESS PURPOSES. A SECOND DUPLICATE PERSONALIZED 3 FUND-RAISING REGISTRATION PLATE MAY BE OBTAINED BY REQUESTING 4 THAT OPTION ON THE APPLICATION AND PAYING THE DUPLICATE PERSONAL- 5 IZED PLATE SERVICE FEE PROVIDED FOR IN SECTION 804. 6 (2) A PERSON WHO WANTS TO PURCHASE A MICHIGAN UNIVERSITY OR 7 STATE-SPONSORED FUND-RAISING REGISTRATION PLATE FOR USE ON A 8 VEHICLE UNDER THIS ACT SHALL APPLY TO THE SECRETARY OF STATE FOR 9 A FUND-RAISING REGISTRATION PLATE PURSUANT TO THE PROCEDURES PRE- 10 SCRIBED IN SECTION 217. AN APPLICATION FOR AN ORIGINAL 11 FUND-RAISING REGISTRATION PLATE SHALL BE ACCOMPANIED BY A $25.00 12 FUND-RAISING DONATION, PAYMENT OF THE REGULAR VEHICLE REGISTRA- 13 TION TAX PROVIDED FOR UNDER THIS ACT, AND A $10.00 SERVICE FEE. 14 AN APPLICATION FOR RENEWAL OF A FUND-RAISING REGISTRATION PLATE 15 SHALL BE ACCOMPANIED BY PAYMENT OF THE REGULAR VEHICLE REGISTRA- 16 TION TAX PROVIDED FOR UNDER THIS ACT AND A $10.00 FUND-RAISING 17 DONATION. APPLICATION FOR A REPLACEMENT FUND-RAISING REGISTRA- 18 TION PLATE SHALL BE ACCOMPANIED BY PAYMENT OF ONLY THE FEE PRE- 19 SCRIBED UNDER SECTION 804. 20 (3) A DISABLED PERSON WHO MAKES APPLICATION FOR A 21 FUND-RAISING REGISTRATION PLATE UNDER THIS SECTION AND WHO MAKES 22 PAYMENT OF THE REQUIRED SERVICE FEES SHALL BE ISSUED, AS DETER- 23 MINED BY THE SECRETARY OF STATE, A DISABLED PERSON'S TAB AS PRO- 24 VIDED IN SECTION 803F FOR HIS OR HER FUND-RAISING REGISTRATION 25 PLATE OR A DISABLED PERSON'S FUND-RAISING REGISTRATION PLATE. 26 THE SECRETARY OF STATE SHALL REQUIRE THE SAME PROOF THAT THE 03790'99 9 1 APPLICANT IS A DISABLED PERSON AS IS REQUIRED FOR ISSUANCE OF A 2 PERMANENT WINDSHIELD PLACARD UNDER SECTION 675. 3 (4) A FUND-RAISING REGISTRATION PLATE SHALL EXPIRE PURSUANT 4 TO SECTION 226. THE SECRETARY OF STATE MAY ISSUE A TAB OR TABS 5 DESIGNATING THE MONTH AND YEAR OF EXPIRATION FOR AN ORIGINAL OR 6 RENEWAL FUND-RAISING REGISTRATION PLATE. 7 (5) THE SECRETARY OF STATE MAY ISSUE A TEMPORARY REGISTRA- 8 TION PERMIT TO A PERSON WHO SUBMITS AN APPLICATION AND THE PROPER 9 FEES AND DONATION FOR A FUND-RAISING REGISTRATION PLATE, IF THE 10 APPLICANT'S CURRENT VEHICLE REGISTRATION WILL EXPIRE BEFORE HIS 11 OR HER RECEIPT OF A FUND-RAISING REGISTRATION PLATE. THE TEMPO- 12 RARY REGISTRATION SHALL EXPIRE UPON THE APPLICANT'S RECEIPT OF A 13 FUND-RAISING REGISTRATION PLATE OR UPON THE EXPIRATION OF 60 DAYS 14 AFTER THE DATE OF ISSUANCE, WHICHEVER OCCURS FIRST. THE TEMPO- 15 RARY PERMIT SHALL BE ISSUED WITHOUT A SEPARATE FEE. 16 SEC. 811G. (1) EXCEPT AS OTHERWISE PROVIDED IN THIS ACT, 17 THE SECRETARY OF STATE MAY DEVELOP, MARKET, PROMOTE, AND SELL A 18 COLLECTOR PLATE THAT MATCHES ANY REGISTRATION PLATE ISSUED BY THE 19 SECRETARY OF STATE UNDER THIS ACT. 20 (2) A COLLECTOR PLATE SHALL NOT BE ATTACHED TO A MOTOR VEHI- 21 CLE IN A MANNER PRESCRIBED IN SECTION 225. A COLLECTOR PLATE MAY 22 BE USED ON A VEHICLE IN ANY LAWFUL MANNER, INCLUDING, BUT NOT 23 LIMITED TO, BEING DISPLAYED ON THE FRONT BUMPER OF A VEHICLE. 24 (3) A PERSON MAY PURCHASE 1 OR MORE COLLECTOR PLATES BY 25 MAKING PAYMENT TO THE SECRETARY OF STATE OF THE $10.00 SERVICE 26 FEE AND, IF THE PLATE IS A MATCHING MICHIGAN UNIVERSITY OR 03790'99 10 1 STATE-SPONSORED FUND-RAISING REGISTRATION PLATE AS DEFINED IN 2 SECTION 811E, A $25.00 FUND-RAISING DONATION. 3 (4) THE SECRETARY OF STATE MAY, AS DETERMINED NECESSARY BY 4 THE SECRETARY OF STATE, CEASE TO SELL A COLLECTOR PLATE. 5 SEC. 811H. (1) EACH SERVICE FEE COLLECTED UNDER SECTIONS 6 811F AND 811G SHALL BE CREDITED TO THE MICHIGAN TRANSPORTATION 7 FUND ESTABLISHED UNDER SECTION 10 OF 1951 PA 51, MCL 247.660, AND 8 SHALL BE USED FIRST TO DEFRAY THE MANUFACTURING AND ADMINISTRA- 9 TIVE COSTS INCURRED BY THE SECRETARY OF STATE, INCLUDING ADMINIS- 10 TRATIVE COSTS ASSOCIATED WITH SELLING, ISSUING, REPLACING, AND 11 SUBSTITUTING FUND-RAISING REGISTRATION AND COLLECTOR PLATES. 12 (2) THE SECRETARY OF STATE SHALL IDENTIFY AND SEGREGATE THE 13 FUND-RAISING DONATIONS COLLECTED UNDER SECTIONS 811F AND 811G 14 INTO SEPARATE ACCOUNTS. THE SECRETARY OF STATE SHALL CREATE A 15 SEPARATE ACCOUNT FOR EACH FUND-RAISING PLATE SERIES AND MATCHING 16 COLLECTOR PLATES ISSUED OR SOLD BY THE SECRETARY OF STATE FOR A 17 MICHIGAN UNIVERSITY OR STATE-SPONSORED GOAL PURSUANT TO SECTION 18 811E. 19 (3) AS DETERMINED NECESSARY BY THE SECRETARY OF STATE BUT 20 NOT MORE THAN 45 DAYS AFTER THE END OF EACH CALENDAR QUARTER, THE 21 SECRETARY OF STATE SHALL NOT LESS THAN ONCE EACH CALENDAR QUARTER 22 AUTHORIZE THE DISBURSEMENT OF FUND-RAISING DONATIONS SEGREGATED 23 UNDER SUBSECTION (2) AND, INDEPENDENT FROM ANY DISBURSEMENT UNDER 24 SUBSECTION (2), REPORT THE NUMBER OF FUND-RAISING REGISTRATION 25 AND MATCHING COLLECTOR PLATES ISSUED, SOLD, OR RENEWED BEARING 26 THE DESIGN OR LOGO OF THAT MICHIGAN UNIVERSITY OR STATE-SPONSORED 27 PLATE SPONSOR, TO THE FOLLOWING, AS APPROPRIATE: 03790'99 11 1 (A) THE TREASURER OF A MICHIGAN UNIVERSITY. 2 (B) THE PERSON OR ENTITY IDENTIFIED IN A PUBLIC ACT PURSUANT 3 TO SECTION 811E(3) TO ADMINISTER A STATE-SPONSORED FUND-RAISING 4 REGISTRATION PLATE FUND. 5 (4) THE SECRETARY OF STATE MAY CEASE TO ISSUE A FUND-RAISING 6 REGISTRATION PLATE OR TO ISSUE A DUPLICATE REPLACEMENT OF A 7 FUND-RAISING REGISTRATION PLATE FOR USE ON A VEHICLE IF THE SEC- 8 RETARY OF STATE ISSUED FEWER THAN 500 OF A PARTICULAR 9 FUND-RAISING REGISTRATION PLATE WITHIN ANY PRIOR 24 CONSECUTIVE 10 MONTHS. THE SECRETARY OF STATE MAY ALSO CEASE TO SELL A COLLEC- 11 TOR PLATE THAT MATCHES THE DISCONTINUED FUND-RAISING REGISTRATION 12 PLATE. HOWEVER, THE SECRETARY OF STATE MAY CONTINUE TO RENEW 13 FUND-RAISING REGISTRATION PLATES ALREADY ISSUED AND COLLECT THE 14 RENEWAL FUND-RAISING DONATION FOR THOSE PLATES. THIS SUBSECTION 15 DOES NOT APPLY TO MICHIGAN UNIVERSITY FUND-RAISING REGISTRATION 16 PLATES ISSUED UNDER SECTION 811F AND MATCHING MICHIGAN UNIVERSITY 17 COLLECTOR PLATES ISSUED UNDER SECTION 811G. 18 (5) THE STATE OF MICHIGAN, THROUGH THE SECRETARY OF STATE, 19 SHALL OWN ALL RIGHT, TITLE, AND INTEREST IN ALL FUND-RAISING REG- 20 ISTRATION AND COLLECTOR PLATES, INCLUDING THE RIGHT TO USE, 21 REPRODUCE, OR DISTRIBUTE A FUND-RAISING REGISTRATION OR COLLECTOR 22 PLATE OR THE IMAGE OF A FUND-RAISING REGISTRATION OR COLLECTOR 23 PLATE IN ANY FORM. THE SECRETARY OF STATE MAY AUTHORIZE THE COM- 24 MERCIAL OR OTHER USE OF A FUND-RAISING REGISTRATION OR COLLECTOR 25 PLATE DESIGN, LOGO, OR IMAGE IF WRITTEN CONSENT IS OBTAINED FROM 26 THE PERTINENT MICHIGAN UNIVERSITY OR PERSON OR ENTITY THAT 27 SPONSORED A STATE-SPONSORED FUND-RAISING REGISTRATION PLATE UNDER 03790'99 12 1 SECTION 811E. HOWEVER, THE SECRETARY OF STATE SHALL NOT 2 AUTHORIZE THE COMMERCIAL OR OTHER USE OF A FUND-RAISING REGISTRA- 3 TION OR COLLECTOR PLATE UNDER THIS SECTION UNLESS THE USER FIRST 4 AGREES IN WRITING TO THE TERMS AND CONDITIONS THAT THE SECRETARY 5 OF STATE CONSIDERS NECESSARY. THOSE TERMS AND CONDITIONS MAY 6 INCLUDE THE PAYMENT OF ROYALTY FEES TO 1 OR MORE OF THE 7 FOLLOWING: 8 (A) THIS STATE. 9 (B) A MICHIGAN UNIVERSITY. 10 (C) A PERSON OR ENTITY THAT SPONSORED A STATE-SPONSORED 11 FUND-RAISING REGISTRATION PLATE. 12 (6) A ROYALTY FEE PAID TO THIS STATE UNDER A WRITTEN AGREE- 13 MENT DESCRIBED IN SUBSECTION (5) SHALL BE CREDITED TO THE 14 MICHIGAN TRANSPORTATION FUND ESTABLISHED UNDER SECTION 10 OF 1951 15 PA 51, MCL 247.660. 16 Enacting section 1. Sections 6d, 17b, 30b, and 811d to 811o 17 of 1949 PA 300, MCL 257.6d, 257.17b, 257.30b, and 257.811d to 18 257.811n, are repealed effective 5 years after the effective date 19 of the amendatory act that added those sections. 20 Enacting section 2. This amendatory act takes effect 21 October 1, 2000. 22 Enacting section 3.
