SENATE BILL No. 804 October 13, 1999, Introduced by Senators JOHNSON and SIKKEMA and referred to the Committee on Health Policy. A bill to amend 1978 PA 368, entitled "Public health code," by amending section 21513 (MCL 333.21513), as amended by 1993 PA 79. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 21513. The owner, operator, and governing body of a 2 hospital licensed under this article: 3 (a) Are responsible for all phases of the operation of the 4 hospital, selection of the medical staff, and quality of care 5 rendered in the hospital. 6 (b) Shall cooperate with the department in the enforcement 7 of this part, and require that the physicians, dentists, and 8 other personnel working in the hospital and for whom a license or 9 registration is required be currently licensed or registered. 04039'99 * CPD 2 1 (c) Shall assure that physicians and dentists admitted to 2 practice in the hospital are granted hospital privileges 3 consistent with their individual training, experience, and other 4 qualifications. 5 (d) Shall assure that physicians and dentists admitted to 6 practice in the hospital are organized into a medical staff to 7 enable an effective review of the professional practices in the 8 hospital for the purpose of reducing morbidity and mortality and 9 improving the care provided in the hospital for patients. This 10 review shall include the quality and necessity of the care pro- 11 vided and the preventability of complications and deaths occur- 12 ring in the hospital. 13 (e) After December 31, 1989, shall not discriminate because 14 of race, religion, color, national origin, age, or sex in the 15 operation of the hospital including employment, patient admission 16 and care, room assignment, and professional or nonprofessional 17 selection and training programs, and shall not discriminate in 18 the selection and appointment of individuals to the physician 19 staff of the hospital or its training programs on the basis of 20 licensure or registration or professional education as doctors of 21 medicine, osteopathic medicine and surgery, or podiatry. 22 (f) Shall assure that the hospital adheres to medical con- 23 trol authority protocols according to section 20918. 24 (G) EXCEPT AS OTHERWISE PROVIDED IN THIS SUBDIVISION, SHALL 25 ASSURE THAT AFTER DECEMBER 31, 2004, THE HOSPITAL DOES NOT USE 26 MERCURY, COMPOUNDS OR SUBSTANCES THAT CONTAIN MERCURY OR HAVE A 27 MERCURY CONTENT, OR EQUIPMENT, SUPPLIES, OR PRODUCTS THAT CONTAIN 04039'99 * 3 1 MERCURY OR HAVE A MERCURY CONTENT. AFTER DECEMBER 31, 2004, IF 2 NO MEDICALLY ACCEPTABLE, MERCURY-FREE ALTERNATIVE TO A COMPOUND 3 OR SUBSTANCE OR TO EQUIPMENT, SUPPLIES, OR PRODUCTS USED BY THE 4 HOSPITAL EXISTS, THE HOSPITAL MAY USE THE COMPOUND OR SUBSTANCE 5 OR EQUIPMENT, SUPPLY, OR PRODUCT THAT CONTAINS THE LOWEST MERCURY 6 CONTENT AVAILABLE ON THE MARKET. 04039'99 * Final page.
