        A bill to amend 1976 PA 451, entitled

   "The revised school code,"

   by amending section 1178 (MCL 380.1178), as amended by 1995 PA

   289.

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 1178.  (1)  A  SUBJECT TO SUBSECTION (2),
             A school

 2    administrator, teacher, or other school employee designated by

 3    the school administrator, who in good faith administers medica-

 4    tion to a pupil in the presence of another adult or in an emer-

 5    gency that threatens the life or health of the pupil, pursuant to

 6    written permission of the pupil's  parents  PARENT
             or guardian,

 7    and in compliance with the instructions of a physician is not

 8    liable in a criminal action or for civil damages as a result of

 9    AN ACT OR OMISSION IN the administration OF THE MEDICATION,

 1    except for an act or omission amounting to gross negligence or

 2    willful and wanton misconduct.

 3         (2) IF A SCHOOL EMPLOYEE IS A LICENSED REGISTERED PROFES-

 4    SIONAL NURSE, SUBSECTION (1) APPLIES TO THAT SCHOOL EMPLOYEE

 5    REGARDLESS OF WHETHER THE MEDICATION IS ADMINISTERED IN THE PRES-

 6    ENCE OF ANOTHER ADULT.
