A bill to amend 1949 PA 300, entitled "Michigan vehicle code," by amending section 235 (MCL 257.235), as amended by 1988 PA 470. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 235. (1) If the transferee of a vehicle is a new motor 2 vehicle dealer or a used vehicle dealer who acquires the vehicle 3 for resale, the dealer shallnot be required toobtain a new 4 registrationofFOR the vehicleorAND SHALL forward the 5certificate of title to the secretary of state, but shall retain6and have in the dealer's immediate possession theassigned cer- 7 tificate of title with the odometer information properly com- 8 pleted TO THE SECRETARY OF STATE, WHO SHALL ISSUE A NEW TITLE TO 9 THE DEALER IN THE DEALER'S NAME. A dealer shall obtain a 10 certificate of title for a vehicle having a salvage certificate 04865'99 TJS 2 1 of title before the dealer may operate the vehicle under dealer's 2 license plates. Upon transferring title or interest to another 3 person who is not a dealer, the dealer shall complete an assign- 4 ment and warranty of title upon the certificate of title, salvage 5 certificate of title, or dealer reassignment of title form and 6 make an application for registration and a new title as provided 7 in section 217(2). 8 (2) The dealer or transferee shall be liable for all damages 9 arising from the operation of the vehicle while the vehicle is in 10 the dealer's or transferee's possession. 11 (3) Upon transferring title or interest to another dealer, 12 the dealer shall complete an assignment and warranty of title 13 upon the certificate of title, salvage certificate of title, or 14 dealer reassignment of title form and deliver it to the licensed 15 dealer to whom the transfer is made. 16 (4) The dealer reassignment of title form shall be pre- 17 scribed by the secretary of state and shall contain the title 18 number of the accompanying title; the name, address, and, if 19 applicable, dealer license number of the transferee; the year, 20 make, model, body type, and vehicle identification number of the 21 vehicle; the name, address, dealer number, and signature of the 22 transferor; an odometer mileage statement pursuant to section 23 233a; and any other information the secretary of state may 24 require. 04865'99 Final page.
