A bill to amend 1978 PA 368, entitled "Public health code," by amending section 2619 (MCL 333.2619), as added by 1984 PA 82. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 2619. (1) The department shall establish a registry to 2 record cases of cancer and other specified tumorous and precan- 3 cerous diseases that occur in the state, and to record informa- 4 tion concerning these cases as the department considers necessary 5 and appropriate in order to conduct epidemiologic surveys of 6 cancer and cancer-related diseases in the state. 7 (2) Each diagnosed case of cancer and other specified tumor- 8 ous and precancerous diseases shall be reported to the department 9 pursuant to subsection (4), or reported to a cancer reporting 10 registry if the cancer reporting registry meets standards 11 established pursuant to subsection (4) to ensure the accuracy and 03190'99 CPD 2 1 completeness of the reported information. A person or facility 2 required to report a diagnosis pursuant to subsection (4) may 3 elect to report the diagnosis to the state through an existing 4 cancer registry only if the registry meets minimum reporting 5 standards established by the department. 6 (3) The department shall maintain comprehensive records of 7 all reports submitted pursuant to this section. These reports 8 shall be ARE subject to the same requirements of confidential- 9 ity as provided in section 2631 for data or records concerning 10 medical research projects. 11 (4) The director shall promulgate rules which THAT provide 12 for all of the following: 13 (a) A list of tumorous and precancerous diseases other than 14 cancer to be reported pursuant to subsection (2). 15 (b) The quality and manner in which the cases and other 16 information described in subsection (1) are reported to the 17 department. FOR A CASE OF CANCER OR OTHER SPECIFIED TUMOROUS OR 18 PRECANCEROUS DISEASE OCCURRING IN A MINOR, THE DIRECTOR SHALL 19 ALSO REQUIRE THE REPORTING OF RISK FACTORS THAT MAY HAVE CONTRIB- 20 UTED TO THE MINOR CONTRACTING THE CANCER OR OTHER SPECIFIED 21 TUMOROUS OR PRECANCEROUS DISEASE INCLUDING, BUT NOT LIMITED TO, 22 ENVIRONMENTAL RISK FACTORS. FOR PURPOSES OF THIS SUBDIVISION, 23 "ENVIRONMENTAL RISK FACTOR" INCLUDES, BUT IS NOT LIMITED TO, ALL 24 OF THE FOLLOWING: 25 (i) A PARENT'S OCCUPATIONAL EXPOSURE TO KNOWN OR SUSPECTED 26 CARCINOGENS. 03190'99 3 1 (ii) THE PROXIMITY OF THE MINOR'S RESIDENCE, DAY CARE 2 CENTER, OR SCHOOL TO PERMITTED SOURCES OF AIR OR WATER POLLUTANTS 3 THAT ARE KNOWN OR SUSPECTED CARCINOGENS OR TO 1 OR MORE SITES OF 4 ENVIRONMENTAL CONTAMINATION THAT CONTAIN KNOWN OR SUSPECTED 5 CARCINOGENS. 6 (iii) THE MINOR'S EXPOSURE TO KNOWN OR SUSPECTED CARCINOGENS 7 THROUGH CONSUMPTION OF GAME FISH OR OTHER FOOD PRODUCTS AT A RATE 8 THAT IS HIGHER THAN THE POPULATION AT LARGE. 9 (c) The terms and conditions under which records disclosing 10 the name and medical condition of a specific individual and kept 11 pursuant to this section are released by the department. 12 (5) This section does not compel an individual to submit to 13 medical or department examination or supervision. 14 (6) The department may contract for the collection and anal- 15 ysis of, and research related to, the epidemiologic data required 16 under this section. 17 (7) Within 2 years after the effective date of this 18 section SUBJECT TO SUBSECTION (10), BY JULY 1, 1986, the depart- 19 ment shall begin evaluating the reports collected pursuant to 20 subsection (2). The department shall publish and make available 21 to the public reports summarizing the information collected. The 22 first summary report shall be published not later than 180 days 23 after the end of the first 2 full calendar years after the 24 effective date of this section JULY 1, 1984. Subsequent THE 25 DEPARTMENT SHALL MAKE annual summary reports shall be made on a 26 full calendar year basis and published AND SHALL PUBLISH EACH 03190'99 4 1 REPORT not later than 180 days after the end of each calendar 2 year. 3 (8) Reporting pursuant to subsection (2) shall begin the 4 next calendar year after the effective date of this section 5 JANUARY 1, 1985. 6 (9) This section shall take TAKES effect July 1, 1984. 7 (10) BEGINNING WITH THE LAST REPORTS COLLECTED PURSUANT TO 8 SUBSECTION (2) BEFORE THE EFFECTIVE DATE OF THE AMENDATORY ACT 9 THAT ADDED THIS SUBSECTION, THE DEPARTMENT SHALL SEPARATE FROM 10 THE REPORTS EACH CASE OF CANCER OR OTHER SPECIFIED TUMOROUS OR 11 PRECANCEROUS DISEASE OCCURRING IN A MINOR. THE DEPARTMENT SHALL 12 PUBLISH AND DISTRIBUTE TO THE PUBLIC A REPORT SUMMARIZING THESE 13 CASES BY SPECIFIC TYPE OR CATEGORY OF CANCER OR OTHER SPECIFIED 14 TUMOROUS OR PRECANCEROUS DISEASE. THE DEPARTMENT SHALL PUBLISH 15 AND DISTRIBUTE THIS REPORT SEPARATELY FROM THE REPORT REQUIRED 16 UNDER SUBSECTION (7), BUT AT THE SAME TIME AS THE REPORT REQUIRED 17 UNDER SUBSECTION (7). THE DEPARTMENT SHALL INCLUDE IN THE REPORT 18 REQUIRED UNDER THIS SUBSECTION THE INFORMATION ON RISK FACTORS 19 DESCRIBED IN SUBSECTION (4)(B). 03190'99 Final page. CPD
