        A bill to amend 1931 PA 328, entitled

   "The Michigan penal code,"

   by amending section 239 (MCL 750.239).

               THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 1         Sec. 239.  (1)  All pistols, weapons or devices  A PISTOL,

 2    WEAPON, OR DEVICE carried, possessed, or used  contrary to  IN

 3    VIOLATION OF this chapter  are hereby declared  IS forfeited to

 4    the state  ,  and shall be turned over to the  commissioner 

 5    DIRECTOR OF THE DEPARTMENT of  the Michigan  state police or his

 6    OR HER designated representative, for  such  disposition as

 7    PRESCRIBED BY the  commissioner may prescribe  DIRECTOR.

 8         (2) THE DIRECTOR OR HIS OR HER AUTHORIZED REPRESENTATIVE MAY

 9    CONDUCT 1 OR MORE PUBLIC AUCTIONS TO SELL FIREARMS FORFEITED

10    UNDER THIS SECTION TO INDIVIDUALS WHO MAY LAWFULLY OWN THOSE

11    FIREARMS.

 1         Enacting section 1.  This amendatory act takes effect

 2    September 30, 1999.

 3         Enacting section 2.  This amendatory act does not take

 4    effect unless Senate Bill No. _____ or House Bill No. _____

 6    into law.
