FISHING ORDERS - H.B. 5670 (H-1): FLOOR ANALYSIS

House Bill 5670 (Substitute H-1 as reported without amendment)

Sponsor: Representative Mary Ann Middaugh

House Committee: Conservation and Outdoor Recreation

Senate Committee: Natural Resources and Environmental Affairs

CONTENT

The bill would amend Part 401 (Wildlife Conservation) of the Natural Resources and Environmental Protection Act to allow the Department of Natural Resources (DNR) to adopt fishing orders prescribing the number of rods, lines, and hooks that could be used for the harvest of salmon and trout, including coho salmon, chinook salmon, pink salmon, Atlantic salmon, lake trout, brook trout, brown trout, rainbow trout, and splake on the Great Lakes and their connecting waters.

Under the Act, the DNR may adopt fishing rules and regulations as it considers necessary for the harvest of new species of game fish including coho or silver salmon, kokanee salmon, chinook salmon, and striped bass in any of the State waters. The bill, instead, would allow the DNR to adopt fishing orders as described above.

The bill also provides that the adoption of an order would be subject to the notice and other procedural requirements of Section 41103. (Section 41103 pertains to orders protecting fish, game, or birds. It requires orders to specify the manner and condition of taking or killing, waters or other areas affected by each order, and length of time the order is in effect. The public must be notified of orders through the hunting, fishing, trapping guides or through newspaper publication.)
