A SUMMARY OF HOUSE BILL 5924 AS INTRODUCED 6-21-00


Under Article 20 of the Occupational Code, entitled "Architects, Professional Engineers, and Land Surveyors", a person who is not licensed as one of the above professionals who is planning, designing, or directing the construction of a residence building up to 3,500 square feet in calculated floor area is exempt from the article's requirements. The bill would increase the square footage allowed under the exemption from 3,500 to 5,000 square feet of calculated floor area.


Further, the code currently defines "calculated floor area" as the habitable areas of a building that are measured to the outside surfaces of exterior walls. It includes a heater or utility room, but does not include a crawl space; a garage, open porch, balcony, terrace, or court; or an unfinished and nonhabitable portion of a basement or attic. The bill would amend the section of this definition pertaining to basements and attics to simply refer to a basement or attic, regardless of whether it is habitable.
