A SUMMARY OF HOUSE BILLS 5658 AND 5659 AS INTRODUCED 4-18-00


House Bill 5658 would amend the Michigan Penal Code (MCL 750.349b) to create an additional felony for certain kidnaping situations where the victim is a minor. The bill would apply to both ordinary kidnaping situations as well as situations where a prisoner took an individual as a hostage. The bill would provide specific sanctions for persons who kidnaped a minor and, during the course of the kidnaping, committed any of the following crimes against that minor: contributed to the minor's neglect or delinquency; recruited or induced the minor to commit a felony; first, second, third or fourth degree criminal sexual conduct; or assault with the intent to commit criminal sexual conduct. The crime would be punishable by imprisonment for life without possibility of parole.


House Bill 5659 would amend the Department of Corrections Act (MCL 791.234) to specify that prisoners sentenced for the crime outlined in House Bill 5658 would not be eligible for parole. Both bills would have to be enacted in order for the either one to take effect.
