A SUMMARY OF HOUSE BILL 5005 AS INTRODUCED 10-19-99


The bill would amend the Natural Resources and Environmental Protection Act (NREPA), to specify that certain individuals could ride off-road vehicles (ORVs) on state trails under certain circumstances.


Currently, under the act, certain restrictions are placed on ORVs. For example, they may not be operated at a high rate of speed. Also, they may not be operated in a state game area or state park or recreation area, or on state-owned or other public lands, except on disignated trails. House Bill 5005 would amend this latter provision to specify that a person 60 years of age or older, or a person with a disability, could operate an ORV on a nondesignated trail, route, or area for the sole purpose of accessing a designated trail, route, or area.


Under the bill, "person with a disability" would mean a person described in Section 103 of the Persons with Disabilities Civil Rights Act (MCL 37.1103).
