A SUMMARY OF HOUSE BILL 4399 AS INTRODUCED 3-9-99


Currently, the Worker's Disability Compensation Act of 1969 construes "personal injury" to include respiratory and heart diseases or resulting illnesses, and considers such diseases or illnesses as arising out of and in the course of employment in the absence of evidence to the contrary (and thus compensable under the act). This provision currently applies to members of "full paid" fire departments (whether run by county road commissions in counties of one million or more people, by state universities or colleges, or by cities, townships, or incorporated villages) if the firefighters are employed and compensated upon a full time basis; county sheriffs and deputies; members of the state police; conservation officers; and Michigan Public Service Commission motor carrier inspectors.


The bill would amend the act to add volunteer city, township, or (incorporated) village firefighters to the act's provisions regarding compensation for job-related respiratory or heart diseases or resulting illnesses.
