A SUMMARY OF HOUSE BILL 4162 AS INTRODUCED 2-3-99


The Natural Resources and Environmental Protection Act (NREPA) specifies that, with the exception of lands that are managed by other state agencies in carrying out their respective duties and responsibilities, the Department of Natural Resources (DNR) has jurisdiction over the management, control, and disposition of all land under the public domain. House Bill 4162 would amend the act to exclude from this provision state lands in which the state held mineral rights for the exploration and production of oil or gas. Under the bill, the Department of Environmental Quality (DEQ) would have exclusive jurisdiction over these state lands.
