A bill to amend 1994 PA 451, entitled "Natural resources and environmental protection act," by amending section 51109 (MCL 324.51109), as added by 1995 PA 57. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Sec. 51109. (1) For revenues disbursed after June 30, 1994, 2 to determine the proportion for the disbursement of revenues 3 under this part and for attribution of revenues under subsection 4 (2)(b) for revenues collected under this part, the number of 5 mills levied for local school district operating purposes to be 6 used in the calculation shall equal the number of mills for local 7 school district operating purposes levied in 1993 minus the 8 number of mills levied under the state education tax act, Act 9 No. 331 of the Public Acts of 1993, being sections 211.901 to 10 211.906 of the Michigan Compiled Laws 1993 PA 331, MCL 211.901 00029'97 JLB 2 1 TO 211.906, for the year for which the disbursement is 2 calculated. 3 (2) Except as provided in subdivision (b), for revenues dis- 4 bursed after June 30, 1994, the revenues collected under this 5 part shall be distributed as follows: 6 (a) In the case of intermediate school districts receiving 7 state aid under sections 56, 62, and 81 of the state school aid 8 act of 1979, Act No. 94 of the Public Acts of 1979, being sec- 9 tions 388.1656, 388.1662, and 388.1681 of the Michigan Compiled 10 Laws 1979 PA 94, MCL 388.1656, 388.1662, AND 388.1681, all or a 11 portion of the amount that would otherwise be disbursed to these 12 intermediate school districts from the following revenue sources, 13 as determined under a formula prescribed by the department of 14 management and budget on the basis of the tax rate utilized to 15 compute the amount of state aid for the intermediate school dis- 16 trict, shall be paid instead to the state treasury to the credit 17 of the state school aid fund established by section 11 of article 18 IX of the state constitution of 1963: 19 (i) Revenues from that portion of the levy of a specific tax 20 over 15 cents per acre pursuant to section 51105. 21 (ii) Revenues from that portion of state payments in excess 22 of 25 cents per acre which are made pursuant to section 51106. 23 (iii) Revenues from remitted withdrawal penalties and fees 24 imposed pursuant to section 51108. 25 (iv) REVENUES FROM REMITTED STUMPAGE OR YIELD TAX COLLEC- 26 TIONS MADE UNDER FORMER 1925 PA 94. 00029'97 3 1 (b) For revenues disbursed after June 30, 1994, the amount 2 that would otherwise be disbursed to a local school district for 3 school operating purposes shall be paid instead to the state 4 treasury and credited to the state school aid fund established by 5 section 11 of article IX of the state constitution of 1963. 6 (3) Except as provided in subsection (2)(a), as used in this 7 section "revenues" means all of the following: 8 (a) The specific tax levied pursuant to section 51105. 9 (b) State payments made pursuant to section 51106. 10 (c) Withdrawal penalties and fees imposed pursuant to sec- 11 tion 51108. 12 (d) Declassification penalties and fees pursuant to section 13 51116. 14 (E) REVENUE FROM REMITTED STUMPAGE OR YIELD TAX COLLECTIONS 15 MADE UNDER FORMER 1925 PA 94. 00029'97 Final page.
