The House of Representatives has amended the bill as follows:

1. Amend page 2, line 13, after "care" by inserting "IN ACCORDANCE WITH THE PUTATIVE FATHER'S ABILITY TO PROVIDE SUCH SUPPORT OR CARE".

2. Amend page 2, line 23, after "purposes." by striking out the balance of the subsection and inserting "UPON ENTRY OF AN ORDER GRANTING CUSTODY AND LEGITIMATING THE CHILD, THE CLERK OF THE COURT SHALL COLLECT A FEE OF $35.00 FROM THE PUTATIVE FATHER. THE CLERK SHALL RETAIN $9.00 OF THE FEE AND REMIT THE $26.00 BALANCE, ALONG WITH A WRITTEN REPORT OF THE ORDER GRANTING CUSTODY AND LEGITIMATING THE CHILD, TO THE DIRECTOR OF THE DEPARTMENT OF COMMUNITY HEALTH. THE REPORT SHALL BE ON A FORM PRESCRIBED BY OR IN A MANNER APPROVED BY THE DIRECTOR OF THE DEPARTMENT OF COMMUNITY HEALTH. REGARDLESS OF WHETHER THE FEE REQUIRED BY THIS SECTION IS COLLECTED, THE CLERK SHALL TRANSMIT AND THE DEPARTMENT OF COMMUNITY HEALTH SHALL RECEIVE THE REPORT OF THE ORDER GRANTING CUSTODY AND LEGITIMATING THE CHILD.

Enacting section 1. This amendatory act takes effect September 1, 1998.".

CIVIL RIGHTS; HANDICAPPER DISCRIMINATION

March 31, 1998

Today I have vetoed and am returning to you herewith, Enrolled Senate Bill 385. This bill has the admirable purpose of changing all references to "handicapped persons" in the Revised School Code to "persons with disabilities." I fully support the legislature's efforts in this regard.

However, under the requirement of Article IV, section 25 of the state constitution, Enrolled Senate Bill 385 reenacts a number of sections of the Revised School Code that have been altered by Executive Order 1996-12. Executive Order 1996-12 transferred certain rulemaking and administrative functions from the State Board of Education to the Superintendent of Public Instruction.

While the Ingham County Circuit Court permanently enjoined Executive Order 1996-12 prior to its effective date of July 1, 1997, that action was appealed to the Michigan Court of Appeals on the basis of the decisions in House Speaker v Governor, 443 Mich 560 (1993) and Morris v Governor, 214 Mich App 604 (1995). Signing Enrolled Senate Bill 385 into law (a subsequent statutory enactment) would revest certain administrative and rulemaking authority in the State Board of Education, undoing some of the transfers contained in Executive Order 1996-12.

Should the legislature see fit to send me a revised version of Enrolled Senate Bill 385 which parallels the relevant provisions of Executive Order 1996-12 with respect to administrative and rulemaking authority, I would gladly sign it. However, because of the unintended consequences that are part of Enrolled Senate Bill 385, I am returning this legislation to you without signature.

I am pleased to introduce to you and my colleagues, Katherine Wale, a guest from the district that I represent, a young lady who is 13 years old, and coincidentally, I represent District 13. She is a very special young woman who has been recognized nationally by the Prudential Spirit Community Award in partnership with the National Association of Secondary School Principals for her activities, her dedication, her leadership, and her volunteerism in the community. Specifically, she donated her time to computerizing a whole library by entering the data for 2,000 books into the school's database. It's those kinds of efforts that were rewarded and recognized on a national basis. She and her family join us today, Madam Governor, and I think this kind of young lady, this kind of spirit that she exemplifies is exactly the type of thing we need to support and encourage. It has been done so on a national level, and I want to let her and the body know how much I appreciate it as well. I would ask you, Madam Governor, and my colleagues to join us in welcoming her.

This occasion scheduled for Friday, May 1, 1998, in Detroit, is a most appropriate opportunity to recognize the role of law in American life; and

Whereas, May 1 serves as Law Day all across the nation. The United States of America has been the citadel of individual liberty and a beacon of hope and opportunity for more than 200 years to millions who have sought our shores; and

Whereas, The foundation of individual freedom and liberty is the body of law that governs us. The Constitution of the United States and the Bill of Rights are the heart of that body of law, which guarantees us many freedoms, including freedom of religious belief, freedom to have and hold property inviolate, freedom of assembly, freedom of speech, freedom of press, freedom of petition, and due process of law, among others; and

Whereas, This year marks the 41st Annual nationwide observance of Law Day, and the 11th Annual celebrated by Wayne County Neighborhood Legal Services - Children's Center for Justice and Peace. The President and the Congress of the United States, by official proclamation, have set aside May 1 as a special day for all Americans to acknowledge the importance of law in their lives; now, therefore, be it

Whereas, Marshall Fredericks' warm, yet intense spirit is reflected in his sculptures, drawings and paintings, which are displayed throughout Michigan and around the world. A recipient of numerous awards for artistic excellence, Mr.Fredericks will long be remembered in Michigan, and Metro-Detroit, specifically for his uplifting "Spirit of Detroit" sculpture which is prominently displayed in front of the City-County Building in downtown Detroit; and

Whereas, While his works range from impressive reflections of religious images to lighthearted animal figures, one theme remains constant--an exuberant celebration of life, in all forms--the beauty, sadness, freedom, and strength of spirit are profoundly embodied in bronze, stone, paint, and other materials; and

Whereas, The passing of Marshall Fredericks touches and saddens us. We are deeply grateful for his generous gifts that radiantly adorn this world. Clearly, this man's vision and devotion to capturing the living spirit is exhibited in his sculptures, drawings and paintings which will continue to live on in his work forever. We will always be able to celebrate the beauty of life through his remarkable contributions; now, therefore, be it

A resolution commending the people of Harley-Davidson, Inc. on the company's Ninety-fifth Anniversary.

Whereas, Few issues have been more important to the people of Michigan in recent years than efforts to point out the pride and ability of the American workforce. With the technical knowledge that our citizens possess, especially in the area of motorized transportation, the Ninety-fifth Anniversary of Harley-Davidson, Inc.--the only major American-based motorcycle manufacturer--is a milestone of interest to many of our citizens; and

Whereas, There are many parallels between the automobile industry experience in Michigan and history of Harley-Davidson. Like many early car companies, Harley-Davidson traces its beginnings to a family operation, with the Davidson brothers building their first motorcycle in the backyard of their Milwaukee home. The development of this project grew with innovation and disappointment, much as cars did. Like the automobile, motorcycle production contributed to the military in time of war. More recently, Harley-Davidson experienced record losses--the erosion of its reputation--and new challenges as a result of foreign imports. With innovation and a new spirit, Harley-Davidson has met these challenges with great success; and

Whereas, To mark the Ninety-fifth Anniversary of this company, an ambitious cross-country fund-raising ride in support of the work of the Muscular Dystrophy Association has been developed. This course will include riders in all parts of the country celebrating this highly respected American manufacturer. The riders will travel through New York and Pennsylvania, passing through Detroit on June 5, and continue up to Mackinaw City and over to Green Bay on June 8, arriving in Milwaukee on June 9; now, therefore, be it

Resolved by the Senate, That tribute be hereby accorded to honor the men and women of Harley-Davidson, Inc. as the company marks its Ninety-fifth Anniversary; and be it further

Senator Dingell's statement is as follows:

Some while ago, I was asked to go and speak before the Law Enforcement Information Network Policy Council. The day they asked me to come and speak was this morning. It was my hope that I could have disposed of my discussions with them before the Senate started, but that was not possible.

For some years now, constituents have been expressing concern to me about police information networks, record keeping networks, and the security of those information systems, preventing their misuse while making information that is needed available. It has been my feeling for some while that the Law Enforcement Information Network Policy Council is not being responsive to the needs of the people of Michigan. This year through the budget process I have been trying to underline for them that displeasure and some avenues that they may want to pursue. We had a lengthy discussion--I represented the views of my constituents in the forceful of fashions. I even took along with me today two constituents who have been the subject of misuse of information from the Law Enforcement Information Network. I think the discussions this morning were very fruitful. I don't think that the Law Enforcement Information Network Policy Council has been chewed out by a state legislator before. I've got to say I felt real good afterwards, especially because the constituents who were upset with them seemed really pleased with my work.
