The bill would amend Public Act 156 of 1851, which defines the powers and duties of county boards of commissioners, to increase from five to 20 years the term for which a county board may purchase or lease real estate for the site of a courthouse, jail, clerk’s office, or other county building in a county.
In addition, the Act requires a county officer to report under oath to the county board on his or her duties and to give a bond for the faithful performance of those duties. An officer who neglects or refuses either to make a report or to give a bond may be removed from office by a two-thirds vote of the county board, and the office is declared vacant. The bill would delete provisions that: permit the county board to fill the vacancy for the unexpired portion of the term for which the officer was elected or appointed; require the vacancy to be filled at an election, if the election occurs before the term expires, and if the office is elective; and require the board to give reasonable notice of the election to fill the vacancy.
